At the time yes, because the USN could not allow any other navy to attack it on the open seas. True, the USN destroyer(s) were conducting De Soto patrols (secret stuff), but they reportedly were upon the high seas when they were attacked by units of the North Viet Navy.

∙ 11y agoIn the US a president can declare a war but it cannot be waged without the support of Congress because it finances the military. Congress clearly felt that something had to be done in the aftermath of the Gulf of Tonkin incident (an act of aggression upon two US vessels) and because of the strong anti-communist beliefs which existed at the time, because it passed the Gulf of Tonkin Resolution, granting the President the power to retaliate against those deemed responsible and attempt to fight against communism by waging war on the Democratic Republic of Vietnam without the need for a formal declaration war.
