He was under age drinking and was arrested for DUI. Musso and Disney had a contract deal that allowed him to stay on the show for one more year and let him do more adult-type projects. After they found out about his arrest, Disney fired him from the show and removed his character immediately out of the show for the third season since they realize that he should do more grown-up shows now that he has a 'tainted' record.

At the third season premise, his character overhears his crush talking to her friend about how immature he can be; and so he wrote a runaway note which his character leaves to Chicago to be more mature. A wonderful way to show his disappearance without just removing him. For the remainer til the show's finale, he was replaced by Adam Hicks who plays the twins' long lost brother, Koz of Mindu.
