Tenth Amendment .....amendment that states rights not specifically given to the federal government are reserved for the states and the people
The 10th Amendment deals with this and a number of other matters. The Constitution does not speak to the issue and for this reason it falls under the 10th Amendment which states: "The powers not delegated to the United States by the Constitution, nor prohibited to it by the States, are reserved to the States respectively, or to the people." As such, the Federal Department of Education is unconstitutional and education is reserved to the individual states.

The 9th and 10th Amendment refer to power reserved for the states the 9th says that a citizen of another state may not sue a state. While the 10th amendment states that powers not granted to the federal government are reserved to the states or people.
