In actual practice however municipalities pass and enforce laws in violation of state or federal laws all the time; most people do not fight it because of the expense involved (a war of attrition).

For example:

  • The City of Farmers Branch Texas passed an anti-Immigration ordinance that made it unlawful to rent to illegal immigrants (May 12th 2007); the Federal Court for the Northern District of Texas ruled that the law could not be enforced until the state and federal courts tested it for its constitutional compliance (May 21st 2007).
  • Despite a preponderance of State Court rulings, and a split Federal Court ruling; cities still install "Red Light Cameras" even though they are ruled as an Unconstitutional money making scheme.
