No. This is because it is not "your" property. If it is being repossessed, it means that the bank "owns" it since you financed it. That is why it's legal for them to take it from you. If you assault a repo man, you will go to jail. Plain and simple. The flip side of this, of course, is that the repo man is acting under restrictions as well. For example, nearly all states will not allow the repo man to "break and enter" to get the property. If you garage door or gate is open, they can go in and pull the vehicle. If its closed, they can't. That's the basic rundown, varies a lot state to state. Some states, you can open a gate or garage door as long as its not locked. Just varies. But don't assualt the repo man, and he better not assault you either.
As a Repossesion Agent, I would like to say a word. Remember that the repo guy is not the one that owns the loan on your car. YOU signed on the line saying you could and would make the monthly payment on the vehicle. I, as do all Repo Professionals, understand that things come up, people get laid off, relatives get sick, etc. Things happen, and that's okay. But if you can't make the payments, you can't keep the car. If that was the way the world worked, we would all have brand new cars. Let me tell you something: I don't drive a brand new car, neither does my wife. I repo because that's how I feed my two baby daughters and my wife. That's how I keep my electricity and heat flowing to keep them warm. I understand you are frustrated and probably embarassed. But don't take it out on the repo man. He is doing his job and working hard for his family.
They can come onto your property because you gave them permission when you signed the loan.If it someone elses property that is trespass but after they have the vehicle the point is moot as long as they didn't damage the property.
First question: Yes, they can come on private property, with some limitations. They may not enter an enclosed building or cross a locked gate. Second question: Unless they gain consent of the owner of that vehicle, they cannot enter or move any other vehicle in order to get to the vehicle they're repossessing.
Yes they can, as long as it is the correct vehicle.
In MOST states, the answer is YES. A few states require a liscense.
yes they can
Yes, as long as the property is not attached to the vehicle as in wheels, radio, etc.
YES, they are allowed to by law and usually the contract you sign gives that in writing.
Call the repo guys OR the lender.
No one has the right to enter your property to repo a vehicle. I your vehicle is out in the street, then its fair game. If you see the repo man coming but has not hooked up to your vehicle, you legally still have possession of the vehicle. Once the vehicle has made contact with the truck the vehicle belongs to him.
Yes !!!!!!!!!!!!!!!
Yes they can come on private propery to repossess a vehicle. If they damaged your property, then call the lender and demand they repair the damage. You may have to sue to recover the damage.
Yes, if they are accompanied by a Sheriff and have the proper documentation stating that the lienholder would like the vehicle recovered.
