He might institute a custody fight. If you leave and do not allow him any contact with his child, the court will not look kindly upon that when determining custody. But that is the least of your worries. If you just take off (for good) with the child without telling him anything, he can have you arrested for kidnapping. If you simply want to move out though and still let him visit the child, there's nothing preventing that. You just need to make sure the communication between the two of you is always very clear. The above is a good post, but wanted to add that if your boyfriend is abusive to you; into drugs; belongs to a gang; is never there or has deserted you on many occasions (or refuses to work) you can seek Legal Aid and go for total custody of your child. However, if your boyfriend has been a fairly good father and the two of you simply don't get along then the advice the above poster gave you is totally correct.
