The turtle may be behaving that way because the weather is getting cold and it is preparing to hibernate. It can be very dangerous and unhealthy for the turtle, to let it hibernate in captivity. If you choose to keep it, you will need to get a heat lamp immediately.
A UV heat lamp will simulate the summer sun and provide the Ultra-Violet (UV) light that the turtle needs, so the turtle will stay warm and go through the winter without hibernating. You can buy a UV heat lamp to put/hang over the tank at most pet stores, including Petco. You can even buy a timer for the tank (not at Petco, though, for some reason), so you don't have to be home to turn it on every morning, and off every night.

Sometimes their over all shell can differ, very much like people and fingerprints. Other times it can be because they have been misidentified, this sadly is very common.
They are imported in bulk an other species find their way into a consignment.
