Can a father give up his parental rights without someone else adopting the child?

Either the biological father has to sign away his rights as a parent, or you can go to an adoption attorney and take that route. If the biological is not active in the child's life, it may be fairly simple. If he is active, the biological can fight for his rights and you will probably end up in court. My husband and I went through this and are going through the phase that I hear most people go through who do legal adoptions. Our children have sought out the biological and he(the biological) is reaking havok on our household-its terrible, so just understand the process and the consequence of your loving action. It can come back to bite you later-possibly, not always. Remember kids always think the grass is greener on the other side. Best of luck though.

How would you handle a school age child not following your rules?

I used to laugh at people at their answers when I use to ask this same question myself. They would say things like, take away privileges and those sort of things. I use to think to myself, " Do they really think I'm so dumb I haven't tried that." The truth is, is that teens are the worst for creating drama. They should all be shipped to Hollywood to at least make some money. The biggest secret is to not lose your cool because they love to see you breakdown. When they see you lose it, their job to get what they want is halfway done. Use resources in your community. Go to your local pathways or mental health center and make them go with you and lay out the rules in front of a professional They are going to take you more seriously. When rules are broke follow through with consequence's. That's why consequences shouldn't be unrealistic but your expectations shouldn't be either. In front of the therapist both of you air out your likes and dislikes about each other and what you expect of each other. let them know that whatever they say they are not in trouble. You might be amazed at what really is bothering them. Whip their slate clean if possible just for making the effort to invest in this possibility that life doesn't have to be so dramatic. And if you fall short of perfection say your sorry. They might start doing the same. I've done this 3 different times with all boys. It wasn't perfect by far. But they made it to adulthood; sort of, and I'm no longer known as the screamin demon. Good Luck

Can you get your parental rights back after you gave them away?

You can appeal the TPR order if you do it within a certain amount of time, usually 30 days. This doesn't guarantee that you'll get them back.

You could, in theory, adopt your children... but this is extremely unlikely.

Other than that: no, you cannot get your parental rights back after they have been terminated.

Can you put child support on someone if hes not the one on the birth certifice it someone else?

It's going to be complicated. The court would first have to issue an order that the man named on the birth certificate is not the child's father. Then, paternity would have to be established for the man that you [apparently] think should be paying child support. Depending on the jurisdiction and the amount of time that has passed since the birth certificate was created, this might not be possible.

How do you collect child support if the father of the child doesn't have a Social Security number?

You can file a claim with the state department's Office of Child Support Services. You can google "Office of Child Support Services" and the name of the state in which you live, and you should be able to find the site. It will be a .gov site. Also, if the father of the child happens to be a U.S. Citizen, then I'm fairly sure that he needs a social security number in order to pay his taxes.

How can you get child support lowered?

Sure you can. The Process* is is called, by most states a 'modification of child support.' Lots of states have whole bunches of people in paid agencies who are supposed to be looking after child support payments. You're going to have to do your own state's agencies and jurisdiction. AND then you might either need to learn alot about child support or hire a good lawyer. Sorry, no uniformity. *Captalized because if you've ever been in the process, it is major and deserves upper case.

Can the single father take away the child from the mother's living place without the court order?

Obtaining a passport for a minor in the US requires both parents. You'd would have to get a court order giving you custody. *Being granted sole legal custody does not necessarily mean the custodial parent can remove a minor child from the US. If the court grants sole custody to one parent and visitation rights to the non custodial parent permission to take the child out of US would need to be granted by the court. The matter might be the jurisdiction of a state or federal court depending upon the resident or citizenship status of the parents.

Who has custody of the child if the parents are married?

In all US states the law presumes that, the mother of a child born as a result of a relationship outside of marriage retains sole custodial rights unless a court rules otherwise. If the father did not sign the birth certificate or a declaration of parentage, a paternity test would be necessary before the court would consider custody, visitation, support or any other issues regarding the minor child.

How much of each check can be garnished for child support in Texas?

The guidelines for the support of a child in this section are specifically designed to apply to situations in which the obligor's monthly net resources are $6,000 or less. If the obligor's monthly net resources are $6,000 or less, the court shall presumptively apply the following schedule in rendering the child support order:

% Net Resources 1 - 20%, 2 - 25%. 3 - 30%, 4 - 35%, 5 - 40%, 6 or more - Not less than the amount for 5 children

If the obligor's net resources exceed $6,000 per month, the court shall presumptively apply the percentage guidelines to the first $6,000 of the obligor's net resources. Without further reference to the percentage recommended by these guidelines, the court may order additional amounts of
child support as appropriate, depending on the income of the parties and the proven needs of the child.

Sections 154.125 and 154.126 of the Texas Family Code.

Does your ex-husband still have to pay child support if he is on disability for life and that is his only income?

Can a father keep a child from a mother if there is no court order?

Neither parent should keep a child away from the other parent if there is no good reason. A good reason would be abuse, neglect, drug abuse, etc... If there are problems with custody and there are not court custody papers, there needs to be. Go to the court house and have the process started. Without these papers, either parent could keep the child (as long as the father is proven to be the father or his name is on the birth certificate) and it is not kidnapping. There is not court order preventing it. Also remember that the mother does not always automatically get full physical custody. The court looks at what is best for the child, not the parents.

What is the percentage you should receive for child support for two children in MS?

There are specific Mississippi Child Support Guidelines, designed to be in the best interests of the child, that the courts use to determine the correct amount of child support. These will be followed, unless both parents agree to an amount other than that calculated by the guidelines, or the courts decide the guidelines are unjust. The guidelines are based on the following percentages of the net income of the parent responsible for support:

  • 1 child 14%
  • 2 children 20%
  • 3 children 22%
  • 4 children 24%
  • 5 or more children 26%

Do you have to have both parents' consent for an underage marriage in Pennsylvania and can one parent sign if they don't have custody over that child?

If you are under the age of 18, then the consent of the CUSTODIAL parent or Guardian is necessary. So, if this parent does not have custody, then they cannot sign for you to get married.

Where can you get another student loan to pay your ex child support if you are a full-time college student and he won't let you talk to your kids unless you give him money?

Answer

The short answer is, you can't. You can't get a student loan specifically to pay your child support. You may be able to get a private loan from a bank, but you will have to pay that back eventually as well.

The previous answer was false on every point:

"Actually, child support payments are based on your income. If you are a full time student with no job, you have zero income, so you do not have to pay child support."

Incorrect. Nearly every state has a minimum child support amount. Most states assume that you can earn minimum wage, so your child support will be based on that amount, even if you don't have a job.

"Also, your child support payments after graduation will be based on income after expenses of the student loan, so it should be small. Pay high payments on your student loans and you can justify not having to pay child support, or very little."

Incorrect. Child support payments are based on income, but do not take into account any loan payments at all. Most states calculate a "self-support" amount (the amount required for food and housing) and subtract that from your total income, but they do not subtract car payments, student loans, or any other type of debt. You might be able to get a hardship exception if you can prove to a judge that you can't afford the required child support payment amount.

"You should go to school as long as you can, because the longer you are in school, the fewer years you need to actually pay child support."

Incorrect. You must still pay child support, regardless of school attendance.

"By the way, if you are a woman, you should be receiving the child support, since it is the man that should be paying."

Absolutely false! If the father has full custody of the child, why would he be required to pay child support to the mother?! In every state, the parent who has less than 50% custody of the child owes child support to the parent who has more than 50% custody, regardless of gender.
