You cannot voluntarily relinquish parental rights under Pennsylvania law unless the child is being adopted. The courts may involuntarily terminate parental rights under specific (and dire) circumstances.

Many people are operating under the false assumption that signing over their rights absolves them of child support responsibilities when often, it does not....not unless the child is legally adopted by another adult willing and able to assume financial responsibility for the child.

Can custodial parent waive back child support in South Carolina?

With the exception of cases involving Welfare, child support is not mandatory in any state. However, this is not a good idea for the obligor parent, especially one who wishes to simply pay the other parent directly.

In a California case, the children (age 18 & 22) of a separated man were allowed to sue their father for $134 million dollars in retroactive child support. The parents were never married. However, since 1988 the father voluntarily paid the mother $18,000.00 a month in child support, without a court order, so it was a called gift by the court.

How much child support can be taken out of your check with 8 kids?

First your paycheck with your NET take home pay (net pay after all deductions) that you have in your hand will not have anything withheld from it because it is issued to you after all of the necessary taxes and other amounts that the employer is required to withhold from your gross wages, salary, earnings, etc.

You should get this information from your employer payroll department as they will be the one that would know how much FICA, federal income tax, state income, local taxes, etc they will have to withhold from your hourly pay or gross pay for the pay period. They will do this before they issue your net take home paycheck to you

Can two men father one child?

Just mixing their sperm is not enough to create a child. The only way to create a fetus is to have a female gamete - i.e. egg - fertilised by a male gamete - i.e. sperm. So the two men could mix their sperm, but they would not know which had fertilised the egg, and would not know who the father would be.

How should a US citizen father prepare for a child custody case against the illegal immigrant mother?

File for custodial rights in the appropriate state court in the city or county of residence. Be advised that the mother's illegal status is irrelevant in custodial proceedings as US law presumes both biological parents have equal rights to a child until a court rules otherwise. Furthermore, if the couple were not married the law presumes the mother (illegal or not) retains full custodial rights to the child until the father establishes paternity, files suit for parental rights and a ruling is made by the court.

Is it legal to pay child support to two states?

Maybe, obviously if the order(s) pertains to two or more children residing in different jurisdictions then it's legal. The other reason might be that the child support was in arrears therefore the government agency or court of jurisdiction in that state is allowed to collect money owed.

Apply to "Vital Statistics" in your State (under births/deaths) and you may be able to get the forms online. Go to: www.google.com then type in "Forms for Birth Registration in the State of ____________." Good luck Marcy * When the father does not sign the birth certificate at the time of birth the court will require a notarized affidavit from the father acknowledging his paternity before the birth certificate can be amended. If the father does not wish to comply, the birth mother must file a petition with the court to order a paternity test.

If a mother signs over her rights to her children does she still have to pay child support?

Perhaps, even if the court grants a Termination of Parental Rights petition it does not mean the requesting parent will be relieved of his or her financial obligation, that decision is made by the judge. A TPR is not a venue to allow a parent to escape their financial obligation to a minor child, if that is the sole purpose of the petition it will not be granted. Generally a TPR is only granted to allow a minor child to be eligible for legal adoption by a new spouse or party.

If illegal immigrant mother leaves country and father gives up all rights does he still have to pay child support?

IRS Deduction

Regardless of any custody agreement, or court order the IRS has it's own definition of who the custodial parent is. Section 152(e)(4) defines custodial parent as the parent having custody for the greater portion of the calendar year and noncustodial parent as the parent who is not the custodial parent. If you feel that the mother may challenge this, or attempt to claim the child as well you can also double cover your back by having the Mom fill out form 8332, which basically says "I am the custodial parent of this child, and I am giving up my rights to claim the child this year.

The IRS rule is that if you have the child for more than half of the year, and they literally mean 183 days, you are the custodial parent.

Time spent in Day Care and/or School is deducted from the total.

Will your ex wifes marriage affect child support?

That's dependent on state laws and related circumstances. In California, if you file for a reduction due to a layoff, 20% of the income of your spouse or S/O can be used in the calculations. But, all child support is rebuttable. see link to learn more.

Does child support stop when child turns eighteen and is still in high school?

In Illinois, unfortunately, child support does not end at the age of 18. In fact, if the child is continuing on to higher education, child support can continue up to the age of 21!!! Honestly, it makes sense that it should end at 18 since the kid is a LEGAL ADULT at that point and should be able to take care of himself at this point - but that's Illinois for you. Now I'm pretty sure that at this point (past age 18), the checks can be made out to the child instead of the 'parent guardian' - however this change of who's name is on the checks should be made known officially through the courthouse so that child support is OBSERVED as being paid. Always smart to pay through a mediator (courthouse) to avoid false claims of 'non-receipt'. (Only reason I know is because I married a man who divorced in that state and found out about circumstances pertaining to child support; he will HAVE to pay child support until the child reaches the age of 18, regardless, and then will HAVE to continue if the child continues on to college.) Also, in Illinois there is a certain percentage of a paying parent's income that 'must' be given up to child support - doesn't matter how much he makes - last I checked it was, I believe, 20%.
