The legal age of majority can be from 18-21 depending on the state. Only a few states allow a minor to file for early emancipation and such a petition would not be granted on a "Because I want to.." request. If the situation warrants the minor can be removed from the family home and be deemed a ward of the court, and placed in a foster and/or group home. That would only happen after a complete investigation by DSS and a court hearing, the final decision would be made by the presiding judge.

Safe child care includes:

* A designated person who can take care of a child's individual needs * A plan to reach the parent in an emergency A child should not be left in a position of authority or be left alone in situations beyond his ability to handle. Each child must be looked at individually to make sure he or she is physically and emotionally able to handle the given responsibility. The law does not specify the age at which a child can be left alone. However, a child under 10 cannot be left unattended for such a period of time as may likely endanger their health or welfare (ORS 163.545).

Oregon law does not state specifically an age at which children may be left home. ORS 163.545 states, "(1) A person having custody or control of a child under ten years of age commits the crime of child neglect if, with criminal negligence, the person leaves the child unattended in or at any place for such period of time as may be likely to endanger the health or welfare of such child."

Being Forced HomeThe parents can file a petition with Superior Court to have an order of custodial rights granted, if it is granted they can present the order to local law enforcement. Once the police have been served with the order they can take the minor into custody, and either return them to the parents or to a juvenile facility to await a court hearing.

Here is more input:

  • When i was 16 i ranaway, and yes i was filed as a runaway and had to go home BUT my mother did speak DIRECTLY to a cop and he said that if i was 17 there was nothing he could do to MAKE me go home, OR file me as a runaway. He couldn't do either. The only thing is you DO have to be attending school. and at least call your parents and tell them that you are okay if that's what the cop decides.
  • There may be a loophole for 17-year-olds in Texas. Apparently if they are supporting themselves Texas police won't generally force a 17-year-old to go home.

There is no law that restricts your right to move across the country, with a couple of exceptions:

kids younger than 18

and people who can't take care of themselves.

Without notification, the father can challenge. The man need not have ever signed or seen the birth certificate to still be ordered to pay child support.
