Are juries really a way to fairly adjudicate guilt?

While a jury may not necessarily be the best way to adjudicate guilt in every instance, it is still better than the alternatives. The medieval practices of trial and ordeal proved nothing related to guilt. We certainly do not want the government, which brings the charges against individuals to judge whether they are guilty or not, especially after it felt they were guilty enough to bring charges in the first place.

At least the jury system gives defendants the most reasonable opportunity to get a fair adjudication of guilt. The Declaration of Independence did not state that there is an unalienable right to happiness. It stated that there is an unalienable right to the pursuit of happiness. So too, the best that an imperfect society can promise its citizens is the pursuit of fairness.

If a person comes from a culture that is very different, what is against the law in one country, may not even be considered a crime in the other. The criminal justice system is doing a good job?

Depends on who you are in America. If you are a white, conservative, wealthy American then the criminal justice system is doing an excellent job. The majority of the laws are created by these types of persons. If you are a poor miinority with unpopular points of view, then the criminal justice system will systematically exploit, oppress, and manipulate you. These types of persons are usually not involved in, or privy to, the creation of laws. Although the equality of the criminal justice has improved, powerful entities in society are constantly becoming better at discriminating and/or oppressing through legal means.

Is there such thing as an aquatic police officer?

I know that there are definitely two kinds of related police officer:

1. Police diver

2. Marine Police

3. Environmental Police Officer

The first one deals mostly with search and recovery work - being in the water looking for things, such as a discarded murder weapon, or people that have gone missing and are possibly deceased and in the water. It is quite murky and cramped work.

The second is a police officer who is based on a boat and deals with issues on rivers, docks, and out at sea. This could range from security patrols on the river, through to taxation and customs issues.

The third is a police officer who investigates and deals with environmental crime. I do not know if there is any department that has an aquatic specialty, but countries that are coastal and have marine issues may have one.

Factors that motivate witnesses to give information?

I'm not quite sure if i understand but I'll try as best as i can. if you are asking what topics lead us into a conversation about the bible then i can answer that. if we see somebody that looks depressed or possibly is crying, or if we just strike up a conversation with somebody sitting next to us in a public area, we will sometimes read a comforting scripture from the bible. or, if we don't have a bible with us, then we usually will have a brochure or magazine handy. and if that person likes what they read then they can contact the local congregation of Jehovah's witnesses.

i hope this answers your question! :)

Does California have an expungement process to remove a felony conviction from someone's record?

If you were convicted of a felony and are on probation, you can apply for an early probation release as well as to have the felony reduced to a misdemeanor, and later dismissed. If you have completed your required probation or were never given probation, you can apply for an immediate reduction to a misdemeanor, and then dismissal. Yes, California does have a process for expunging felony convictions.

California Penal Code section 1203.4 authorizes a judge to withdraw a finding of guilt and to dismiss a case if statutory requirements are met. If it is a felony, the sentence must have included probation; so felonies that resulted in a sentence involving state prison are almost never eligible. Also prohibited are a many, but not all, sex crimes. Eligibility requirements include having completed probation, paid all fines and restitution, and not currently serving any other sentence or facing any new charges.

Some felonies (but not all) can also be reduced to misdemeanors. This restores lots of rights that are lost with a felony conviction. The procedure is authorized by Penal Code section 17(b)(3).

Expungement in California requires petitioning the court where the person was convicted. The process and fees vary by court. Fees range from $0 to $240. The process always requires some research and paperwork, and often includes appearing in court to try to persuade a judge to grant the petition while the district attorney or probation department try to persuade the judge not to grant it.

Most law firms that specialize in expungement will offer a money back guarantee. Check the credentials of any firm you retain, by checking with the California Bar Association

In some cases, free assistance can also be provided by your county's public defender or legal aid center, but you must meet low-income requirements and wait longer than if you retain a private firm.
