If Superman jailed him every time they tangled, he would just be an ordinary villain.

There probably was an agreement of some sort back then that had the bad guys always lose on every show. There was something about a "Crime Doesn't Pay" rule being in place back then. All that would explain why Lex Luthor never showed up.

No other costumed baddies ever showed up either. It was kind of strange that Superman, the guy that has all the powers anyone could want, fought ordinary bank robbers and such, while Batman, a guy with no super abilities at all (being an expert martial artist, gymnast, scientist, etc. does not qualify as a super power) fought nothing but cagey, costumed criminals with diabolical, dastardly devices (talking about that 1960's campfest gets one all alliterative).
