EB-5 is also known as the Immigrant Investor Program. It was established by Congress to stimulate the U.S. economy through job creation and capital investment by foreign investors. This program provides a way for foreign investors to obtain a green card or conditional permanent residence in the U.S.

Capital investment requirement for the EB-5 program is either a minimum of $1,000,000 or a minimum of $500,000 generated toward a new commercial enterprise. However, to meet the requirement for the latter amount one must invest within a Targeted Employment Area (TEA)--a high unemployment or rural area. Such an area would have an unemployment of at least 150 percent of the national average rate or would be located in an area outside the boundary of any city or metropolitan with a population of 20,000.

The job creation requirements for the EB-5 program is to create or preserve at least 10 full time employees. The investor and their dependents will be granted conditional permanent residence valid for two years after petition's approval.
