How can a father take a child from its mother?
United States
A father cannot take a child from its mother. He needs to try to get custody through the family court.
Generally, if the parents are unmarried the mother has sole custody and control in most states until the father can establish his paternity. Remember, a child's mother can always be identified by medical records. Since the father didn't give birth and he was not legally married at the time of the birth he must establish his paternity. A paternity test can be arranged through the court and once established the father can request visitations, custody and set up a schedule of regular child support payments for the child if the mother retains physical custody.
If the parents are married they have equal parental rights. The father's rights are not superior and he has no authority to keep the child from the mother without a court order to that effect.
To succeed in a petition for custody the father would need to provide evidence that the mother is unfit. The factors used to determine that a parent is unfit are generally governed by state laws with child endangerment being the determining factor. The following include some of the reasons a parent may be declared unfit:

Although I feel fathers should, in most cases, be part of their children's lives and certainly take responsibility for paying child support, it's dishonest to collect child support for two children when you only had one at home. If this was the agreement with the court, then yes, your ex can make you pay back some of that money. Let's hope he has a big heart! Marcy
It is fraud to collect child support for (2) children if a person only has (1) child. The person should absolutely return the money, it is not her's to keep.

Can child support be discharged by bankruptcy?
No...child support obligations may not be discharged in bankruptcy...out of the courts authority. There is virtually no legal way to escape your obligation on this. The Feds will withhold any benefit you may have coming, even well in the future (like Social Security, taxes, etc) to pay it back. And of course, they are YOUR kids...unfortunate they ended up with a morally bankrupt parent that wants to financially bankrupt them too.

Yes. If the parent ever need financial help from the state, they will come after child support from the non-custodial parent first.
Texas has no SOL for child support it must be "paid in full". If there is no court order for support the petition must be filed before the child or children reach the age of 18. If there is a court order the support obligation must be paid in entirety. This means that even when the child/children reach the age of majority (18) any amount in arrears still must be paid. The court will determine if it is to be paid to the child or to the custodial parent or a combination thereof.

I wouldn't do it without written approval of child support enforcement and/or the court. Get a printout on your payments from CSE first. I do hope you're paying through them and with a court order, otherwise anything you're paying could be considered a gift.
