Can you be held in contempt if you pay your own court order child support payments?

No. (But you knew that, didn't you?) The problem might be in proving that you made the payments. To avoid such a problem, pay your child support through either the courts or the State disbursement unit. DO NOT give any money or anything else to the obligee unless you want it to be considered a gift.

Is there a difference in a parent who has custody of the children but not married vs the parent that does not have custody and is getting married and is fighting for custody of the children?

Being married or unmarried is not much of a determining factor when it comes to custody nowadays. In order to have custody changed you would need to prove that either your household and parenting abilities are substantially better than the other parent, or that their situation is detrimental to the children. Having a spouse does not necessarily mean that you are better able to care for the children, especially if the other parent has had custody for a significant length of time without the children having any problems in a single parent household.

What is the average length of time in jail for contempt of court for not paying child support for 1 year in Colorado?

Contempt of court sentences are broadly defined and generally left at the discretion of the presiding judge. However, federal law mandates that a person cannot be held on contempt charges for more then two years unless extenuating circumstances exist.

Can the mother of a child file for child support after the child has turned 18 and both parents went to court and the mother agreeded to dismiss the charges already?

If you agreed to dismiss a claim for child support arrears you cannot file a new case regarding those same arrearages. If you agreed to forego child support prior to the child reaching 18 then it is too late to go back now.

How do you forgive child support debt after child support is stopped?

Only the courts can forgive unpaid support.

And only that not owed the state directly due to the mother being on Welfare at some point.

Can a mother file for child support if the person has found out he's not the farther and they were never married?

You did not mention the state that you are in or born in.

First the father has to be alive

Second did the father give up his rights to you. Terminate his parental custody to you?

If he did. He owes you nothing. And owes nothing to your mother.

Also if the mother never filed for child support and was never supported by the state that you were born and/or living in, and she supported you with her own earnings and nothing else, then child support was never an issue in the first place.

You need to see if you can contact your mother and find out more about your history with your father and her.

Also you should call Child Support Enforcement in your state and see if that is even possible to do.

It may not be possible due to the reasons above and/or now where you are an adult the claim may be null and void.

Depending on the state and all.

And depending on where you were born. Usually the state where you are born handles the child support collections for custodial parents, no matter how many times you move from state to state.

Who knows you may have money waiting for you as well. They may not of been able to find your mother to pay her during your time of growing up.

How can I get the parental rights of my son's father revoked?

You have to have documentation for this reasoning and go to either the attorney you used and they will file a motion to appear before a judge again or go to the court house and file it yourself. Usually better to get the same judge that ordered the first decree. If he is a danger to the child or abusive or unfit, you have to prove it.

Child support is being paid when the child lives with the non custodial parent?

What needs to happen is, you may wanna to go back to the child support office and let them know what's going on. Because normally the only way that child support should be paid in this instance is, when the child only lives with you, maybe on holidays or for the summer months. Unless there is an agreement made by the courts you may want to request that you also carry him or her on your tax return if you continue to pay.

How do you revoke paternity right if the father only acknowledge the child but the child does not bear his father's surname?

There is a fairly brief period in which the man may rescind his acknowledgment of paternity (in Illinois, 60 days). Surnames are meaningless in paternity determinations.

What if the father is not paying child support and is a convicted felon with a criminal history does he still have visitation rights?

Visitation rights and child support are 2 separate issues in court. They see to what is best for the child and it often is to see both parents. It also depends on why he is not paying child support. If there is such order and he is not paying there are ways the court can see to that he does but you need to let them know he is not paying. You can not deny him visitation on your own, that would be breaking the court order and will get you into legal trouble. It's up to the court to decide if he is unfit for visitation based on his criminal past. Just because you've been to jail in the past does not mean you are a unfit parent now.

Is it unrealistic for a 34-year-old single educated mother to move with her child to the United Kingdom from Canada?

Not at all, but it depends what you are leaving behind. Does your ex have custody of your child? If so, then he is going to have to agree on letting you come to Canada. I live in British Columbia, Canada. If he doesn't have custody than I'd go for it. It's beautiful here, not cheap, but certainly not as expensive as where you live. Be sure you have a good plan and where you are going to stay when you get to Canada. Go on the web and find out what provinces are the most lucrative. British Columbia is the highest taxed province in Canada. Our housing is extremely high and hard to afford. If you would like more questions answered please leave me a post and I'll help you. Just ask away! Merry Christmas Marcy I think I notice the problem with that previous answer, you want to move from Canada to the United Kingdom, right? I think the last writer got a little confused. Well funny you should mention what your plans are, I am in the same boat and planning to do something similar. Only difference is I am in the states currently. I would be happy to share with you what I have learned so far and maybe can shed some light on costs, areas, lifestyle etc. Please feel free to contact me at lytninghawk@yahoo.com or dwilford@ureach.com, I am also available by telephone (805)277-9701. My name is David and I am happy to try to help you or anyone else. Thanks for your time, looking forward to hearing from you, David

Can a custodial parent take a non-custodial parent back to court and have the non-custodial rights revoked if the non-custodial parent got a drug charge?

The visitation order can be revoked by the court if it finds the visits place the child in danger or are simply not in the best interest of the child. You should return to court and request a modification due to this change in the circumstances. You should inquire if the court has an advocate with whom you could discuss the situation or you should discuss it with an attorney. An attorney could frame your matter for court in the best way to get the best possible outcome.

This would be up to the judge based on who has the child the most. Sounds like you need to renegotiate.
