Can you fight to get child support even if the father chooses to give up his parental rights?

The act of voluntarily relinquishing parental rights is never a sure thing except in cases where it pertains to allowing a child or children to be adopted. Although it is not necessary for both parents to be in agreement of TPR action, either parent has the legal right to contest the petition especially when it is made for the expressed purpose of the petitioning parent to avoid financial obligations. FYI, judges only grant TPR decrees when there is incontrovertible evidence that the action would be in the child's best interest.

Arkansas laws on primary custodial parent does there have to be a custodial oarent?

Arkansas has no true shared custody, and therefore the judge always indicates which parent has prime custody. Even if the parents agree to shared custody, the non-prime parent is only given the right to the standard visitation unless the parties work out and submit in writing a more lenient visitation schedule. I k now this to be true, because my son and his ex got a divorce and asked for shared custody. The final decree gave his primary custody and her the every-two- weeks, etc., she would have gotten in any case. They shared because he wanted to. My granddaughter thought it would work for her, too, but her ex didn't stick to the plan once he got prime custody and she only sees her son when the papers allow her to.

Does paying child support automatically make you a non custodial parent?

No, depnding on the state, a primary residential and even sole custodial parent can still be ordered to pay if they earn substantially more than the other parent. In some states, household income would also be a factor. see links below

Relinquishing parental rights does not terminate one's child support obligation.

But if you're the one petitioning this, the court is going to question why you would want to retain it while cutting off his access to the child?

If there is joint custody and one of the partners goes to jail and gives power of attorny to someone else over the children can the other ex get custody of the kids?

i think there's a good chance you would get custody, judges don't look kindly on parents in jail, as they can't parent at all from there...call a few family lawyers in your area and ask them about it, they should be able to give you a quick consultation on the phone, let you know what your chances are, then take it from there...good luck

St of tn if prim parent has be charged with child abuse can the non cost parent be charged with emot neglect if he has caused the stress and fefuses to see the child?

This decision would be up to the district attorney and/or child protective services. I doubt it would ever happen. Lack of involvement by the absent parent is not a defense to child abuse.

If a child was born 13 years ago without your knowledge and the mother is now seeking child support will you be obligated to pay if during the relationship she told you she could not have children?

Before child support is ordered they will do a paternity test to make sure the child is yours and if it it then yes you will have to pay child support. The only way you don't is if the mother is married or with a new guy that want's to adopt the child. You can give up your parental rights but you would still have to pay for your child. * If the you are proven to be the biological father through parentage testing, you will in all likelihood be required to pay support. Whether or not the biological mother is married is not relevant. Arrearages can only be recovered according to the state's SOL starting from the date that a court order becomes valid. Due to the unusual nature of the situation it may be possible to be relieved of financial obligation by filing a petition of voluntary relinquishment of parental rights (TPR). The deciding factor would be, the actions of the biological mother to notify and locate you from the time the child was born to the present.

If the biological father just got the order to pay for the child support and now the custodial perant's spouse wants to adopt the 2 year old till what moment does the father has to pay child support?

In most jurisdictions world-wide, adoption terminates the responsibility of the biological parent(s) to pay support. This is effective from the start of the adoption. Technically, it is effective at the instant the court order for the adoption is signed.

While the adoption process is underway, but not finalized, the biological parent(s) is still obliged to maintain the child.

Is it a bad sign if a guy doesnt see his kids and pays child support?

To pay child support is a legal requirement. To see your kids is a personal requirement

only the parents can know if this a good or bad sign. To many moral judgements

are presented to the courts, and would be best settled by people who's lives

are touched.
