What are the rights of a birth parent once she relinquishes their custody to a child?

That depends on the circumstances of the custody modification. Was it permanent, temporary, was the child adopted, did the parent voluntarily relinquish parental rights or were they terminated by the court? No one here can possibly give you an answer without a lot of detailed information including your legal residence. You should really consult an attorney anyway. He or she would be able to provide an informed and detailed opinion on whether or not you have any rights and if so, what they are.

What does signing over your parental rights mean?

I live in WI ..it means you have no rights as far as medical, school and any major decisions but you still have to pay support unless the child is getting adopted...in WI it is not that easy to do

What is the legal age a child can decide which parent to live with in a divorce situation in the state of South Carolina?

18. Until that age, if there is a court order for visitation, it has to be followed. If there is a legitimate reason that the child does not want to visit, then the custodial parent can go back to court and request that the visitation order be modified. But, parents have the right to visit/maintain a relationship with their children, and courts will not deny them that right without a VERY compelling reason. So, unless the non-custodial parent is unfit/the child's in danger/the parent is causing harm to the child in some way/something to that effect, you probably won't be successful. And if the judge feels that the custodial parent is in any way supporting/encouraging parental alienation (I'm not saying that's the case, but if it is…), he/she will not be very happy with them.

Forcing a child to see a parent?

None, as this dishonors the authority of the court, not a good practice to teach children. see link

Can a friend take another friend's child without permission across state line?

Are you married to the other parent? Divorced? Are they paying child support? Do they have "visitation rights?" In some instances the court MAY require you to get permission of the child's other parent to move the child before taking up residence out-of-state.

What are some characteristics of good parents?

I think a lot of it has to do with love, parents make a lot of unintented mistakes. As long as the child knows they are loved, they will be contributing adults. Love allows creativity, learning, discipline, fairness, manners, ethics, morals, phyiscal, mental and emotional developments, emotional boundaries, self-esteem etc. And set a good example for the children and not let your child to be afraid to tell you of anything (this is very important). And never tease them with anything! No matter how jokingly you think you are doing it, the child will feel bad.

How old do you have to be to decide which parent to live with in North Carolina?

Only Indiana and Texas has laws setting out a specific age at which a child can make a choice the court is requiredto abide by, and even than there are some limitations. With those states, it is age 14. In all other states, the general rule of thumb is that a 12 year old can express and opinion, however the judge is under not legal obligation to consider, or even hear it. In either case, a motion to the court must be filed for a determination to be made. However, the child should be informed that there are alternatives to choosing to live with just one parent. The child should also be advised they can express a choice that they remain in one home and each parent can live with them for a designated period of time, than switch. This is called Bird Nest Custody.

Can a child the age of 13 decide which parent she wants to live with in the state of Florida?

This would have to be authorized buy the court. A 15 year old cannot just decide on where to live without proof or justification of a circumstance or situation that endangers the child's wellbeing. If there is such a circumstance where a child is in danger or is abused, it would have to be brought before the authorities.

Can you get your parental rights back after you gave them away?

You can appeal the TPR order if you do it within a certain amount of time, usually 30 days. This doesn't guarantee that you'll get them back.

You could, in theory, adopt your children... but this is extremely unlikely.

Other than that: no, you cannot get your parental rights back after they have been terminated.

Can I get extradited from Costa Rica for failure to pay child support adite for child support?

absolutely. people often do. there seems to be extraditions of US citizens occurring on a monthly basis (if not more often). Costa Rica is the destination of choice for fugitives. we seem to catch most if not all of them though.

Do a maternal grandparent have more rights to a child than a foster caregiver?

In terms of access to grandchildren, in most places grandparents have about the same rights as aunts, which is to say they have no rights that are not specifically conferred by a divorce court considering a specific divorce.

What is the legal age to move out in the State of Wyoming?

There is no 'legal age' in Wyoming, it has not been legislated. Most authorities believe that 12 or 13 can handle another younger child for short periods of time during the day. Other factors include the individual's maturity, the relationship with the other child (siblings can be harder to handle!), the neighborhood and even the time of day.

Is a child legitimate if their parents are married?

No it is a different here as it will be the same two who will marry, then the child will not be a illegetimate one, only if a third person comes in the picture will he be one.

Can the custodial parent sign over temporary custody to non custodial parent?

No. Only the court can grant a guardianship. You need to petition the court for the change in guardianship. You cannot assign your own temporary guardianship to someone else.

What parental rights do domestic partners have?

This depends upon what registry and what jurisdiction you are asking about. The statewide registry of domestic partnerships in California, Nevada and Oregon statutorily provide rights and responsibilities identical to legal marriage. In other places, however, the rights are usually much fewer and are set by municipal law, rather than state law.

How do you deal with emotional and mental abuse by an ex?

== == == == * You are certainly not alone and there are thousands and thousands of women around the world in your situation. I live in British Columbia, Canada and volunteer at an Abused Women's Center. I am not sure if you have some freedom with your abuser or not. Perhaps if you can, go to the closest Abused Women's Center and try to take their programs, but, if your abuser keeps a tight rein on you then you are going to have to go to a friend's house and phone and make an appointment to see a counselor at the Abused Women's Center. Mental Health in your area can help as well and lead you in all the right directions. Remember, once you leave you can't go back!I was married before to a mentally abusive man who became abusive. Oddly enough I did have some freedom, but not much. I went to work, came home, but if I went out even to a movie with a girlfriend I was kept up late with his yelling and screaming as to where I was. I was emotionally exhausted and walked around for over a year like a zombie. One day something snapped in me and I found myself hunting for my own apartment, then I went back to the place my husband and I lived in and took 1/2 of everything and moved in. I changed jobs and friends. He did phone me begging me to come back and when I refused he became very enraged. Oddly enough he didn't bother me at work. However, once he did come to my apartment and thank God, I had a girlfriend there. I kicked his butt out the door (gave him no choice or I would have phoned the police.) I did get rid of him. Not all abusers are as easy as my ex to handle and I took a risk. Some abusers will kill for much less than a woman leaving his control. Please watch out for yourself. You will certainly need counseling because these abusers (mental or physical) leave scars and you need to know the tools so you won't return to your abuser or choose another abusive mate. Right now I'm sure you are thinking that there is no way if you could get away from this guy that you would go back, but the stats are high that many abused women go back to their abuser or choose another abusive mate. Victims have basically gone into "survival mode" and they become emotionally confused. They have lost their dignity, their individuality and are left to feel they can't get along out in the world without their abuser (not true!) That's a cheap trick to keep the victim under control.I really wish you luck hon, and if there is anything else I can do to help please repost and I'll see it.Stay strong!

* Hi. You mentioned hes an EX. Do you have children together? If so that can be tough. If not just totally ignore him. Its hard to answer your question not knowing the circumstances such as is he bothering you? is he harassing you legally? Thanks. == == == ==

* The last poster asked some good questions. Children or not the Abused Women's Centers are willing and able to handle this. Abused or not, if you can get away from your ex one day, head for that Abused Women's Center! If there are children involved many mother's would fight to their dying breath to get the children away from the abusive behavior. The husband/boyfriend doesn't have to lay a hand on the children (only you) to be emotionally damaging to the children. Children find it extremely difficult to cope with constant arguing in the household or seeing their mother hit.

* I have a little girl and witnessed all the beatings I received. I finally left after 12 years. I gave my life to God. Maybe that can be a start for you. I was scared and lost and I thought that it was OK for me to live like this, but at 17 years old I was not smart about my choices. I'm 29 years old and just left my ex 11 months ago. Seek God, find out who you are. Be around positive people.

Please don't stay in the situation you are in, I know it's really scary and when you get out of that situation, all of a sudden the world feels huge. Trust me life gets better. It took me 10 yrs to pluck up the courage to get away. I don't think there is any abuse you can think of that I didn't go through. Some Christians entered into my life and I gave my heart to Jesus. I got out of the situation and I've been healed of the pain.

Appart from sharing this, I don't tend to look back only froward, it seems like it happened to someone else.

What are the components of the well child visit?

Vaccinations given to children in a well child visit vary depending on the age of the child and what vaccinations they have previously received.

What is the legal role of a parent?

Legally it can be defined as being responsible for the financial and physical, educational needs of children, until the age of majority. That age in most states is 18. Legal responsibility also includes criminal or civil disobedience incurred. For example if your sixteen year old has an auto accident (regardless if you gave them permission or not) you would be equally responsible for damages. Response to above: Unless of course you charge your child with theft. Parents can also be sued now in Canada to support their children in University if it is proved the young adult is making efforts to further their career, and not wasting time in school. This of course is a Canadian law, and will inevitably spread to the USA within time, as socialism always does. As far as responsiblity goes, men have 90% of the onus of resonsiblity.

Can a grandparent get legal custody if the grandchild has lived with the grandparent for 11 years?

Should have 10 years 11 months ago, and filed child support on BOTH parents, so yes.

Can a father who has joint custody with the mother stop her from moving in state without providing proof of residency?

The mother must provide the address where the child will be living because the father has the right to that information in the best interest of the child. If she does not, the father should return to court and request a hearing on the issue. A mother who continues to be uncooperative in that way could lose custody.

Can the single father take away the child from the mother's living place without the court order?

Obtaining a passport for a minor in the US requires both parents. You'd would have to get a court order giving you custody. *Being granted sole legal custody does not necessarily mean the custodial parent can remove a minor child from the US. If the court grants sole custody to one parent and visitation rights to the non custodial parent permission to take the child out of US would need to be granted by the court. The matter might be the jurisdiction of a state or federal court depending upon the resident or citizenship status of the parents.

How do you prove child endangerment?

Pictures are worth a thousand words! Either sneak around and take the pictures or have a detective do the job.

Here are a few laws of child endangerment:

  • Leaving a child in a car alone.
  • Letting her child stay alone with one or more of her boyfriends while she is not there.
  • Leaving the child at home alone.
  • Bringing strange men into the home frequently.
  • Having too many parties where alcohol or drugs are prevelent.
  • The mother is an alcoholic or on drugs.
  • The mother lives with an abusive mate and the environment is not suitable for the child.
  • Leaving the child with 'just anyone' who is not mature enough to look after the child.

These are but a few, but a good start.

Get the goods by pictures if you can or by reports by neighbors (check out complaints made to the police) and then see a lawyer.

Why does your child lie so much?

It's become a type of addiction to the reactions that result from it.

A little lessen.

At birth, until age two, the human brain is at the same intellectual level as most upper level mammals, such as dolphins. Some things can be learned, through a high level of repetition, but overall long-term memory is not yet established. Yes, there are children that develop earlier and faster, but their average life span is also much shorter. People like Einstein didn't develop their full intelligence until in his 20s.

At age two, the brain begins developing the ability for long-term memory storage. This is what most parents call the terrible twos, but there is nothing terrible as it shows the wonder of the human brain. It that time when we really separate ourselves from all other mammals that inhabit this planet.

First, you need to understand that the ability for conceptual thought, or the understanding of right from wrong, does not even BEGIN developing until puberty. Until this age, the word "wrong" is jus that, a word with little to no relational meaning. In addition, for ten years from age 2 on, everything is just words and things, action and react.

When you tell a child not to do something, those are just meaningless words because in the child's brain they are not yet connected to a specific action or reaction. Until puberty, something has to be repeated at least six times for it to become a permanent memory. Just as you used repetition in teaching letters and numbers, you use repetition in all aspects of a child's life. Even after puberty, this should continue as that final stage is not completed for another 12 years in girls, and 18 years in boys. Christ was not mature enough to leave home until age 30.

When you want a child to not do something, you determine an action they do not like, such as standing in the corner, than when they do it again, you repeat the same reaction. You want to form a memory in their brain that if the commit a certain action, you are going to reaction with something less pleasant, until that point is reach where the very though of doing it brings up the picture in the mind of your reaction, so they don't do it. If you change your reaction to an action, such as the first time you make them stand in a corner, but the next time they sit in the corner, that's a completely new and different image in their minds, creating a completely new memory path, making your job of stopping their committing the action twice as hard.

Though people have grown to hate the TV Show "Jon & Kate Plus 8", they had it right in their use of discipline. Every action committed on the part of the children that was not proper, the child sat in a corner, and not just any corner. It was a specific location, so that in their minds was pictured the exact same image of that corner in the house. It may take as few as three times, or it may take a dozen times. Remember, their action is also not exactly the same each time.

You tell them not to touch the hot pot on the stove. Now to you, a two quart of hot boiling water is just as dangerous as a two-cup pan of hot boiling water, but to the child it's not. The size and shape are completely different, and without actually experiencing the sensation of something very hot, the word hot means nothing to them.

You know it is because you experienced it at some point, and you now possess the ability to understand what something means, but your child does not and just as your parent had to teach you, so now it's your job to do so. In twenty years, your child will be repeating the process.

Just as it was for a thousand generation past, so it is now, and will be for unknown generations to come. This is a time of great learning for your child, but it's just data. Their world is more the world of the imagination of the mind. Don't try to rush them for it will be over far too quickly. In those ten years, their brain will absorb and store 2.9 Petabytes of data. That's more than the total amount of data be carried on the Internet right this moment. You are the source and they are the sponge. Feed that little mind with what it needs to eventually become a contributing member to Our Society, but for right now, don't obsess over the little things, for it will pass, and the day will come when you will miss them.

What age can a child decide what parent to live with in Wisconsin?

Only Texas has that law, but with significant restrictions. In all other states, it's a case by case basis, with the Judge interpreting the maturity of the child, and their intent, but this still does not override other evidence in the child's best interest. It's just a piece of the evidence.
