If you murder a pregnant woman is the a double homicide?

User Avatar

Asked by Wiki User

No. Homicide is the killing of one person by another. A fetus is not legally a person, and so does not count as a second homicide if the mother is killed.

Of course, that doesn't mean that the judge can't impose a more severe sentence in such a case, if he decides that the situation warrants it.

What do you call an unintentional murder?

User Avatar

Asked by Wiki User

The term "murder" means a premeditated or preplanned killing of another person. You may be thinking of unintentional homicide, which could range from manslaughter by culpable negligence to justifiable homicide. In the case of the latter, the person must be committing a lawful act in order to claim justifiable homicide - self-defense or accident. He could still be charged with homicide by culpable negligence.

Who killed Adam Walsh?

User Avatar

Asked by Wiki User

John Walsh, the host of TVs America's Most Wanted became an advocate for crimes against children after his own son Adam was kidnapped and murdered in Hollywood, FL in the early 1980s. Adam was taken from a department store with his mother nearby and was found much later decapitated. Walsh suspected that a drifter named Otis Toole was the murderer and just recently was proved by DNA testing. Toole wandered the country with another murderer name Henry Lee Lucas murderering and robbing any number of people. When Adam Walsh was taken, Toole had been left by himself because Lucas was finally arrested and was in prison in Texas. Toole was finally arrested himself and was sent to prison but was never charged with Adam's murder. He died in prison never admitting any guilt in the Walsh crime. Interesting fact:Lucas was originally given the death penalty which was later commuted by then Texas govener George W. Bush. Lucas and Toole claimed to have killed hundreds of people all over the country. When discovered that they had grossly inflated the number of murders they committed Bush felt he could not be executed for crimes he may not have committed, hence the commuted sentence. Lucas died in Huntsville prison in Texas without a true body count.

The Charles Manson gang. it is interesting- as it befuddled the police- only ONE of the Five Manson murders on the Cielo drive site ( unlike the related LaBianca grocery murders- which did involve gunshots) involved a firearm, an unusual nine-shot revolver by Harrington and Richardson. The morbid jokesters referred to Manson"s Full House- Three Jacks ( male victims) and Two Queens ( Sharon Tate and Abigail Folger).

Why did Columbine occur?

User Avatar

Asked by Wiki User

It's hard to say, but there's evidence of the two shooters at Columbine, Dylan Klebold and Eric Harris, being bullied on a daily basis. Many say that this made them snap and plan to take it out on the school that they hated so much.

Also, if you take the time to read (or read about) their journals, they wrote entry after entry of incredibly angry rants. They hated mankind and thought that they were more evolved or more enlightened than everyone else around them.

They didn't really kill anyone in particular at Columbine... They just wanted to achieve a high body count.

The bottom line is that they were disturbed kids who were treated poorly and hated humanity. They didn't just one day snap...they'd had this massacre planned for well over a year. i agree they planned it for over 12 months and they planned it pretty well to bad that they did what they did they could have been very successful in life

Asked by Wiki User

There does not appear to be a statute for "reckless homicide" in Florida. In such cases, cases of homicide would be treated as some degree of just that, homicide.

There are two statutes for vehicular and vessel homicide. These are listed below:

782.071 Vehicular homicide.--"Vehicular homicide" is the killing of a human being, or the killing of a viable fetus by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another.

(1) Vehicular homicide is:

(a) A felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(b) A felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084, if:

1. At the time of the accident, the person knew, or should have known, that the accident occurred; and

2. The person failed to give information and render aid as required by s. 316.062.

This paragraph does not require that the person knew that the accident resulted in injury or death.

(2) For purposes of this section, a fetus is viable when it becomes capable of meaningful life outside the womb through standard medical measures.

(3) A right of action for civil damages shall exist under s. 768.19, under all circumstances, for all deaths described in this section.

(4) In addition to any other punishment, the court may order the person to serve 120 community service hours in a trauma center or hospital that regularly receives victims of vehicle accidents, under the supervision of a registered nurse, an emergency room physician, or an emergency medical technician pursuant to a voluntary community service program operated by the trauma center or hospital.

History.--s. 16, ch. 74-383; s. 6, ch. 75-298; s. 12, ch. 86-296; s. 14, ch. 96-330; s. 9, ch. 98-417; s. 1, ch. 99-153; s. 2, ch. 2001-147.

782.072 Vessel homicide.--"Vessel homicide" is the killing of a human being by the operation of a vessel as defined in s. 327.02 by another in a reckless manner likely to cause the death of, or great bodily harm to, another. Vessel homicide is:

(1) A felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(2) A felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084, if:

(a) At the time of the accident, the person knew, or should have known, that the accident occurred; and

(b) The person failed to give information and render aid as required by s. 327.30(1).

This subsection does not require that the person knew that the accident resulted in injury or death.
