It can happen. It is perfectly legal. While it may be an inconvenience, consider the inconveniece the lender has experienced because the contract they had with the car has been broken, and the loan has gone into default.
In reality, the recovery agents may take possession of the vehicle anywhere they can secure it and maintain the peace. With that in mind, they will most likely take it any time anywhere they can do so without having to engage in a discussion with anyone else.

Yes, if the current value of the car is not enough to settle your outstanding loan + any charges that have been added leading up to the repossession.
Think of it this way -
You borrowed MONEY to get the car. You owe back this MONEY not the car (because the value of the car is going down all the time while you are using it and it is getting older)
If you fail to pay back the MONEY they have a rite to take back the car as an asset against this MONEY you owe.
If when the car is resold it does not sell for enough MONEY to pay off your debt, then you still owe the people some more MONEY.

Working in auto finance I'd have to say no, I have never seen that happen. Advice- you should never come to a point where you need to be thinking that. But if you should come in that situation it is best to communicate with the lender and let them know what is going on with you financially, a lot of lenders have options for the customer.
