Is a recent accident caused by bad weather the driver's fault?

This may depend on which state you live in but in almost every state the answer is yes. The weather conditions will not play a role in determining fault in an accident. The reason for this is because if the weather is poor you should have been driving slower and more cautious.

Got in a car accident yesterday date being 1-7-09 and i got the other persons number and drivers license . agreed she would pay the damages but the next day the phone was disconnected. what do i do?

You go to the police, report the accident, file a report (to get a report number), and provide all the info the other driver gave you. Then you call your insurance company, file a claim, and provide all the info the other driver gave you.

If a car is parked in a parking spot that is labeled no parking and you bump it in a parking lot who is at fault?

The default answer is the car that is moving is at fault unless the moving car has the right of way. However parking lots are messy and there will be no police reports unless the damage is over a certain amount ($2500 I think). The best thing to do is handle it without insurance companies.

How much money do you get from a neck injury due to a car accident?

You are paid based on your actual damage and loss due to an accident not based on "how much can I get". Sounds like you have no real loss and deserve no "moneys". Remembers, fakers can also get prison for fraud if they can't prove actual loss. These fraudulent give me money people are what makes insurance premiums go up for everybody.

Who is at fault if you are driving on a roadway and a parked car pulls into your lane?

A "parked" car will not pull into anything because it is parked.

Ok, not a parked car, but a car waiting in a private drive to get out into the roadway. No signals for the car in the private drive to proceed. The light is red, you wait for the car in the private drive to get out into the eastbound lane in front of you, because that is what they are signaling to do. But when light turns green, the car in the private drive is talking on cell phone and does not proceed or indicate they intend to proceed. The cars behind you are honking for you to proceed, and you do proceed, and the car from the private drive bolts out in front of you and tries to get in WESTBOUND lane (did not indicate this by any action at all) They bolt out so fast in front of you, that you hit them in the rear quarter panel. The car who pulled out in front of you, from a private drive and you hit, leaves the scene of the accident after exchanging ins info, even though you indicate that you are calling the police. And the police come after they leave, and determine it is not your fault, it is the fault of the person pulling out of the private drive. BUT both my ins company and their ins say it is my fault! I threaten to get a lawyer and demand to have this person's phone records produced, showing that they were talking on the phone and they were distracted. (which my ins co was going to do initially, but the other person refused to have cell phone records released) So my ins company takes back their claim that I am liable and they are doing further investigating. It has been over a month now, and my ins company still has not determined liability, after initially claiming I was liable. How long do they have to determine liability? My car has $1500.00+ dollars in damage and I have personal injury, and the vehicle that pulled out in front of me had $450.00 dollars in damage, and no personal injury. Wouldn't it be in the best interest of my ins company to do a very thorough investigation of the accident, taking pictures of the scene etc. Instead of just going with the other person's ins decision that I was liable? Seems to me that my ins company would fight for me, instead they just concede to the other person's ins very quickly. Even though the police report says I AM NOT AT FAULT AND SHE IS?

Who is at fault if you are pulling into a parking space and are more than halfway into it when another driver reverses and hits the rear right door of your car?

The driver of the other vehicle. You were moving and they were stationary, hence they didn't yield right of way to you. Chance are, the parking space was private property, so a citation wouldn't be issued. Laws in your state may vary.

What happens if a car hits you?

You will probably die. or atleast be a vegetable. Answer 2 There are too many variables to be definitive. The main one being how fast the car is going. What type of car it is. What angle it hits you at. What clothes you are wearing. Are you in/on a vehicle yourself, or are you a pedestrian. How old you are.

What if you are not a fault for accident but get into an accident?

If you are not at fault for the accident and sustained injuries or property damage as a result, you may be compensated by the party who caused it. Also, if you have insurance, any expenses you incurred (whether for your treatment and medication as well as repairs) shall be reimbursed by your insurer.

Obtain details of the other person involved - name, address and registration. Seek medical attention. Report to the police and then contact a solicitor to deal with matters rather than an insurance company.

Yes, you can. In a 'rear end' collision the most common injury is whiplash which strains the neck.

When backing out of my driveway I looked both ways and then backed out and a car came around the corner speeding and clipped my bumper. Damage down to other car but not mine. Whos fault is it?

Unless you can prove the other car was violating the posted limit, the onus to ensure the road was clear is completely yours. Even if you CAN prove the other car was speeding, this may not remove all of the fault from you.
