I think this also depends on who instigated the breakup. If She broke up with you to date your brother that is not very nice at all, there should be a period of grace between a couple where you agree to stay away from mutual friends romantically while you move on.

If he dumped you, i think that it is kind of ok to date your ex's brother.

I wish I had something good to tell you but You have to examine him carefully and determine yourself if he's right for you before anything else. I'm sure he knows about your thoughts but you have to know that people that are illegal here go through bad situations and is best if you don't make him feel bad about it. Try to know his family, friends, past life and you might figure it out.
