Can a 15-year-old be emancipated or legally move out of her parents home?
Yes it is possible, but its important you think about this one a little more because this is what will happen to you: Emancipation basically means you are divorcing your parent(s). This means the mother (or father or both) that love you very much will not be allowed to have anything to do with you. So, if you should become emancipated from your mother and change your mind .... oh, oh, guess what? You just can't change your mind like that. You more than likely will be a ward of the court system and this means you can go into foster care. While there are many wonderful foster care providers out there, there are some pretty bad ones too and you could end up worse off than you are now. If you mother feeds you, puts a roof over your head, loves you, cares about where you are and what you are doing; perhaps drives you to school, cares whether you get good grades or not then you should consider yourself very lucky. There are many kids out there that have no parents either due to death or the parents didn't care enough to keep their child(ren.) These are not reasons to leave home: Told to do certain chores around the house Told to come home at a certain time Told when and where you can go Told to do your homework Scolded for not doing homework Scolded because you are cheeky or swearing Told you can't get any body piercing Told you can't die your hair a vivid color Told you can't go to rave parties Told you can't drink or smoke I could go on and on, but you get the picture. Emancipation from a parent can take a long time, and it's not easy. You will be forced to go into court and I doubt you would like that one. Try helping your mom a bit more and sitting down and talking to her and if you feel she isn't being fair then sit down and tell her why you don't think she is being fair. Perhaps on one of two subjects she will compromise with you. I don't know of any state that will allow a 13-year-old to be emancipated. In order to be emancipated you have to prove to the court (among other things) that you are capable of fully supporting yourself without any assistance. You have to pay your own rent, buy your groceries, pay utilities, etc AND remain in school. A 13-year-old can't even get a job, so how can they do that?
