What is form 16 mean in India?

What is Form 16?

If you are salaried employee in an organization, then you will get the salary after deducting tax by the employer. This process is called as Tax Deduction at Source(TDS). Every company has to get the TIN. TIN is Tax Identification Number. This number is issued to person who is responsible to deduct Tax on payments made to employees.

At the end of financial year, company must issue a form 16 which contains the details about the salary earned by that employee and how much tax deducted. It will have details on each month. In simple terms Form 16is details about the tax deducted by the employer in behalf of employee. The same will be paid to governemt by the company. Many people thing that getting the Form 16 alone is enough for the tax filing. Tax payer has to use the Form 16 to file the IT return every financial year end.

For example, if you have worked in two different companies in the same financial year, he must obtain the two Form 16 to file the IT returns.

What is Form 16A?

The purpose of the Form 16 and 16A is the same except the issuing person. Form 16 is applicable only to the salaried employee. There is many other areas where TDS can be applicable like deducing the tax for interest earned by your Fixed Deposit in the Bank. Here bank is the person who deducts the tax. For every financial year they must issue a TDS certificate to the customer. They have to fill the Form 16A and hand over to the customer.

Importance of the contract act is not now limited only to a particular field. but if we see in the present era of globalization, liberalization and industrialization every organisation, institute, company, government concerns, private businessman all are engaged in a direct or indirect manner. apart from private business man with his concern with other business man he have to enter into many other contracts for the same business like carriage, insurance of business and goods, purchase and sale of machinery, contracts with emlpoyers and employees in his concern and many other emplied contracts. in educational institutes an institute enters into contract with their students, faculty, trasportation, mess, hostel concerns, construction etc, loans from banks, etc. in international era in respect of international business and IPR like licensing of copyright, patent, royality fees etc all are the contracts.

Actually if we say in a literal contrast about the contracts in the present times, contract is entered into b/w the two bodies (person, organisation, institute etc) to secure their interest, money, liablility in a contractual obligation. So, the scope of the contract can never end but it will go on expanding with the passage of time.

Difference between Non judicial stamp paper and Judicial stamp paper?

Judicial and non-judicial stamp papers both are issued by court with a certain validity period & purpose mentioned at the back of stamp paper.

If a person or a community gives a guarantee, say for a certain performance of work on judicial stamp to the 2nd party and if he didn't perform that work. Then to forfeit the guarantee amount given by 1st party, the 2nd party has to request to Court and the court will actually forfeit the amount and provide it to the 2nd party. It will not be the case if the guarantee will be on non-judicial stamp paper. In the second case the sufferer (2nd party) simply forfeits the guarantee amount from the 1st party's bank without concerning court or even 1st party itself and it will be a legal action.
