Would a judge waive the parental consent on a marriage license for a 17-year-old who is enlisted and leaving for boot camp?

I would suggest explaining your situation with a local Family Law Attorney or your local County Clerk's Office. * It's not likely for two reasons. The first is, once the minor begins serving active duty he or she becomes automatically emancipated. The second reason is, military personnel need the permission of the commanding officer before they can marry.

If you deny a prior marriage on application for a marriage license is the marriage legal?

No. If you go through a marriage ceremony while still married to someone else you are committing a crime.

If your marriage license was not processed due to a technical error but you had a proper wedding do you need to go through a divorce if you separate?

I believe you would need to call the office where your marriage license was issued, and ask them about the laws in your state. In some states you would still be married, regardless of the SNAFU.

I had this happen - and the lady at the office in the courthouse said "If you intended on getting married - you're married." So, yes, I had to have an attorney and the whole works.

If you are not legally married, you cannot get divorced. However, a technical error with the marriage license may not necessarily mean you are not legally married. It may be still legal, or you may be common law married.

If you are not legally married, you can still file a civil suit for the dissolution of property.

Can two lesbians get a marriage license and have a ceremony in a state that doesn't allow same-sex marriage?

If you found out your marriage license was invalid due to not getting it in the time frame allowed could you have a second wedding to make it legal?

Answer

A wedding is really just a ceremony to celebrate and show that you're getting married. I think it would be sort of odd to have another wedding just because of a marriage license technicality. Maybe you could just renew your vows and make the whole thing less formal than a regular wedding. Your friends and family might think you just want more presents if you have another wedding.

Answer

Unless you have told others, then say nothing and go to the court house to make it legal. If you were married in a church I have no idea how you managed to get married without that license. The above poster is correct in saying it would be odd to have another wedding. I wouldn't even celebrate it again. You are married and just need the paper to prove it. If you want to celebrate have a second honeymoon even if it's a mini holiday or night in a luxurious hotel.

What to do if you never filed your marriage licenses?

You don't file a marriage license. You show your license to the person who officiated at the wedding. He then gives you a marriage certificate and you file that. If you haven't done it, go down to the county clerk where you got the license and ask how to file it. You may have to pay a late fee. Your marriage is still valid.
