The parent(s) can put anyone's name on the birth certificate.

This statement is not true in the state of Kansas. My son had a child with a married woman who was separated from her husband. In the state of Kansas the husband is always considered the father of the child. In order to get the true parent's name on the birth certificate a divorce has to take place and then the real parent has to go to court to ask for his name to be put on the birth certificate.

A divorce is not needed but the biological father has to provide proof via a DNA test and show the court and then his name can be put on the birth certificate.

No they can't. A birth certificate is not proof of identity unless accompanied by an official ID issued by the state or federal government, such as a drivers license, state identification card, or a passport.

Here in the Philippines, a mother can not just name any person as the father of her child in the Birth Certificate. They will look for a marriage contract as their reference when you named your child under his/her father's surname. Or if not married, they let the father fill up the Affidavit of Acknowledgement/Admission of Paternity at the back of the Birth Certificate.

If the mother is not married to anyone else there is no one else considered to be the more likely father, so the father's marital status does not bar him from claiming the child and signing the birth certificate if he is willing to do so.

No. However, if the alleged father has signed the birth certificate, he is acknowledging that the child is his. There are steps to take in order to be taken off of the birth certificate and relieved of the obligation of child support, including a paternity test and an amendment to the birth certificate.

Yes he does. If he wants to see his child he needs to go to court to set up legal visitation and support of the child. If he refuse's to comply with the court on child support they could pronounce him the father and he would have to pay child support anyway. Most fathers are having DNA tests done in the hopes of getting out from under child support and it works if they are not the biological parent.

It depends on your age and why you're changing your name. If it's for marriage, it's easy to just Google it for the process, as there are many agencies that you need to notify in order to change your name.

If you're changing your name for a reason other than marriage, you usually have to petition the court in your local area for a legal change of name. If you're under age, then it has to be originated by one of your parents or legal guardians, and both parents must agree to the change by signing the petition. After that, a judge reviews and approves / denies the request but it's rarely denied.

In any case, the Clerk of the Circuit Court in your County is probably the best place to start, as they'll have the forms for such a process, and they'll tell you what you need to do in order to accomplish it.

In Illinois, no - the court will simply terminate your obligation if the DNA test shows what you apparently think it's going to show. I suspect other States have similar laws.

Second, that child may have inheritance rights according to the law in the particular state or other jurisdiction. In the United States a minor child he cannot be disinherited if his father dies even if his father leaves all his property to someone else in his Will. His mother could file a claim against the estate. As an adult he can make a claim against the estate in some jurisdictions if his father dies intestate, or without a will.

In Michigan when a child is born the mother fills out a form. The mother is asked if she is married and instructed based on her answer what information is needed. Paternity is established through court. If you are married or the father accepts paternity it is a legal matter. I'm still amazed at people stating the father signed the birth certificate. In Michigan there is no place on the certificate for any signature outside of the doctors.
