Well, when I moved out, I looked up the child support percentage of pay and that is what I asked my husband for. I needed more for school fees and such and he helped with that. You both might go to mediation and figure out what changes she needs to make (smaller house?) or what additional amount you might consider paying in the interim before divorce is final. You would maintain health insurance.

your not notified when the non-custodial parent files their taxes and your not entitled to notification. if you are worrying about the parent filing and claiming your child/children there is really no way other then whomever files first with the childs social security number will force the 2nd parent filings to be kicked back because the child has already been claimed. to correct that you need to provide legal court documents saying you have the right to claim the child that year and it is a long drawn out process. unfortunately the IRS has NO WAY of knowing who is legally entitled to claim which child which years

Gosh, I could tell you what I think about this man but I will keep my mouth shut. Sweetie always remember "what comes around goes around." One day God will show him what he deserve but for now if you don't need his help for your baby, don't let him close to you and your baby. But if you do need help to support the baby, he is responsible for your baby. By law the father needs to support his own child. This time be smarter than him, tell him what he needs to do or you can talk to a lawyer that has something to do about child support. You mentioned that he is living with another girl, did she knows that he has a child from you? This are your leverage, don't let him walk all over you..

Yes, but not likely. The court has the option by law to put the noncustodial parent in jail for contempt of court. The grounds for contempt of court per the family courts is a bit different in each State and country. But, the laws are way out of line. It is my opinion that no father should be subject to jail for not paying or falling behind.

But, this is the present reality. So, you must take it seriously. If you cannot send the full payments, send something! anything even if it is $5.00, It will show that you are paying and you are not refusing to disobey the laws. which is called,"intent" in legal terms the court must prove that you had an intent to not pay before they can get a serious order to hall you to jail.

Do not hide from the Child Support courts. It does no good. I do not know what the personal situation is but, hiding and acting like the laws do not pertain to you is only going to work against you. If you call them and write them and then show up to court if you must it will be better and almost impossible for them to put you in jail.

They want money. That is all they want. If you lost your job or are sick and your income is different than before, go to court and ask for a change. Pay what you can. If you paid steadily for 7 years and you are in financial trouble let them know.

You will always owe back pay or arrears, 99% of all noncustodial parents are in arrears. That is a long story, but it does not make you go to jail. As long as you come clean and pay what you can and keep them informed you will be ok.
