It is up to the discretion of the courts as to whether or not your license will be returned if you owe back child support. Since you did not pay even the small amount that was ordered, they may not be very willing to work with you, but if you can pay a substantial portion of the debt they may give you time to make up what is still owing.

This depends on state laws and also, why is he not emancipated if he is 18? He should be automatically at 18, at least in most states if not all. You need to leave more information about marital status between the parents, why he moved out and where to, what state you are in etc.

What happens with child support if a child says he is emancipated?

If you're in the US... A child saying he is emancipated means nothing (I can say I'm God, but that doesn't mean I am :). If the child actually is legally emancipated, then child support ceases.

If the grandparents do not have legal permanent custody and the mother has proof she is the child's legal custodian, even if she has been absent in the child's life--yes, they can. If you believe the mother is unfit to care for the child or you have had physical custody for a long period of time with little or no contact from the mother, you can file an emergency appeal for custody with the courts. A temporary custody paper will not keep the child with you if she ever signed one as she can revoke it at anytime.

Do you still have the right to see your child if there has been no contact for nine years?

You haven't mentioned whether you are the mother or father, whether you were married to the other parent or whether you ever established your parental rights legally if you're the father. If you are the father and you haven't had any contact with your child for nine years it is likely that you never established your paternity. You may need to do that now if the custodial parent has any objections to your desire to obtain a visitation schedule. When you establish your paternity the custodial parent can request a child support order and seek back support.

Keep in mind that your sudden appearance will be disruptive for the child and the family and you should try to respect the custodial parent's right and desire to minimize the emotional effect on the child. You need to take things slowly since your child was not given the opportunity to develop a relationship with you. You will be a stranger. You should contact the custodial parent or guardian to arrange a time to discuss your desire to become part of the child's life. If you are not on good terms perhaps you could enlist the help of a friend or relative to act as a go-between initially. You should try to keep the process friendly and cooperative.

What are the custody laws of a child born out of wedlock in Illinois?

Generally, if the parents are unmarried the mother has sole custody and control in most states until the father can establish his paternity. Remember, a child's mother can always be identified by medical records. Since the father didn't give birth and he was not legally married at the time of the birth he must seek other means of establishing his paternity and that is done through paternity test. A paternity test can be arranged through the court and once established the father can request visitations, custody and set up child support for the child.

Can a parent open an adult child's mail if it concerns insurance benefits that the adult provides?

Mail is private and if it is addressed to an adult should not be opened by anybody except the adult to whom it is addressed.

Exceptions would be by the police when investigating a crime, by a person authorized by the adult to open the mail, by a person with power of attorney for the adult due to the fact that the adult is incapacitated.
