As long as it is not stolen, to keep your ass outa trouble go to the police and tell the police the story on whats going. I had this same problem only thing is that I paid for the item and they reported it stolen, so I'm out $400 and a decent laptop.

This would be a lesson for answerer number one to keep receipts. If someone gave me something then threatened to report to the police that I had stolen it. I would immediately return the item to that person and that would be it. No "thing" is worth the unnecessary hassle of trying to clear my name. It should also be a lesson to not accept "gifts" from someone you don't know well enough and don't know their motive for giving it to you.

3. If the case was closed by virtue of the court granting a motion to dismiss (usually the Plaintiff is given a chance to amend the complaint, but he may not), the same rule as in #1 above would apply.
