Can a felon sell and serve alcohol?

Yes, but what do you mean by felon? Someone convicted of a felony 10 years ago that has completed their sentence is still a convicted felon. There is no law forbidding them to drink. Someone on active probation/parole can drink unless they are specifically ordered not to drink. A positive urinalysis for alcohol is not a violation unless they are ordered not to drink.

What are the disadvantages of parole?

Disadvantages to the Parolee:

* unfair and inane blanket parole stipulations * excessive reporting requirements

* prejudicial treatment * stigma/taboo * lack of freedom * restricted movement * difficulty obtaining employment * difficulty obtaining apartments * police harassment Disadvantages to the Parole Officer:

* blanket parole stipulations that do not address parolee issues * forced to be responsible for one who has proven irresponsible * drug testing parolees who will not stop using * forced to listen to lame excuses * lack of space in jails and prisons limits disciplinary options * limited options for parolee living placement * limited options for parolee work placement * law enforcement interference Disadvantages to society:

* excessive expense due largely to corruption and incompetence within the system * inordinate focus on certain classes of criminals rather than those who represent true dangers

* lack of a true, accurate understanding or knowledge of the previously convicted (preconceived notions) and the problems surrounding corrections

* lack of focus on the problems surrounding corrections due to lack of interest * lack of understanding of the true dangers that can arise due to lack of understanding and lack of focus or interest

Can i own a gun while on misdemeanor probation?

Actually, it depends on the circumstances. If you are on probation for some sort of felony, you can no longer own a gun unless you have your rights restored.

If you are on probation for something other than a felony, it depends on what the crime was and the terms of your probation are.

Does a parole officer have legal rights to enter a paroles house without the parole present?

Generally, yes. But be wary of harrassment.

YEP... As a parolee you lose your rights to privacy in your residence. A parole officer can do unscheduled searches without warrants at any time to make sure you are following the rules. It is a condition that you agree to when you go on parole. Know that a regular officer is sometimes with the parole officer when they search, but the regular officer cannot participate in the search though. If a regular officer participates in the search anything he/she finds may be thrown out because the right to search only extends to the parole/probation officer.

Do inmates get cash when they are released?

No. Generally they are released with the clothes they entered with, the clothes they may have purchased to wear for visits while incarcerated, or are issued ill fitting Khakis or other institutional clothes. No funds are issued. If the inmate has no family or friends to pick him up from the correctional institution, the DOC will, if notified in time, issue a bus ticket and escort the inmate--still in chains--to the bus station.

Actually for California, inmates do get cash "Gate Money", they get so much money for each day they were incarcerated. My ex-husband was in prison, when he was released after serving 3 or 4 months he was given about $80 or $90 when he was released. Also, they didn't keep the clothes he was wearing when he was arrested. He said they trash it, I had to send him "Dress Outs", which is basically whatever clothes he wants to wear when he's released so long as it is approved by the prison.

**Note**: Each state will have a different policy as is evidenced by the comment about the CA penal system. Idaho allows inmates to earn a little cash while in prison depending upon their custody level. It isn't very much: the hourly wage ranges from .15 cents/hr for janitorial work in state-owned buildings to as much as 1.00/hr for wildfire fighting in the rangelands and forests. The inmate (if smart) can sock away a nice little nest egg by the time he hits the gate. Nevertheless, the state does NOT pay them "gate money". That is a stupid policy IMO.

What is the consequence for violation of felony probation for the second time in Florida?

Most likely the convicted individual will be required to serve the entire sentence that was originally imposed before he or she was placed on probation plus any resulting penalties due to the probation violation and/or other criminal acts.

How much jail time does a defendant serve for burglary in Florida?

Depends on your criminal history, first conviction, with a decent lawyer or even a public defender you may get probation depending on the situation of the crime, second offense or with low-level criminal history, possibly one to five with the possibility of parole after two years, however with a good lawyer you may get off with probation...long criminal history with similar offenses ,pack a lunch ,make some friends you're gonna be in for while.... Lets say you broke into a car (door was open) and you stoled a 2 fire arms and a taser. This is your first offense as an adult. how much time could you get for this crime.

Is it against the law for a convicted felon to live in a house that has a rifle in it?

Yes, if the convicted felon has access to the rifle, it is illegal.

Not exactly. The convicted felon cannot posses a firearm, but that does not mean everyone in the household is also punished and banned from possessing a firearm.

Do felony warrants expire?

How long does a convicted murderer have to serve before being eligible for parole?

There are a number of factors that go into play as to how much time must be served before parole is a possiblity. The crime and special circumstances are a big part. Whether your in a state or federal prison, your prison record once you are there. (trouble makers get extra time for being naughty) What state you were in when you committed the crime. How remorseful you are is another big factor. Parole boards most likely won't let you out if your not sorry for what you did. If you aren't sorry chances are you will do the same thing again when you get out.

Most things are not black and white. And I would not want to sit on a parole board. It's an awsome responsiblity.

Is it better to live above someone or below someone in an apartment and why?

It depends on what you want in your apartment. It's quieter to live above someone, especially if they tend to have parties and a lot of guests. Also, living one floor down tends to reduce the number of steps that you have to climb to get to your apartment. Heating the lower floors also tends to be a little less expensive, especially if the upper apartment is the top floor since heat loss is typically only through the outside walls and ceiling. Also, lower floors will have water damage if there is a problem with the plumbing upstairs. You just need to figure out what you want and go after what would be best for you. Remember that the best apartments tend to be "penthouse" apartments, which are typically on the top floor of apartment buildings.

When is it okay to violate ones privacy?

The answer to that is simple.. when you have probable cause. Unless the department, police or any other department can convince a judge that eavesdropping or gaining access to private information is with good reason, only then should any department or police unit be granted such rights. The sad truth is that our private information is being access and our privacy violated every day from such tyrannical government's. The want your money, your mind, your children, your last breath to be uttered while in debt to the country and government you have served your entire life. This is the harsh truth. Low to medium earning families are nothing but sheep tagged with identification numbers via IRA or ATO until you retire and die due to one of there man made diseases. Quit living like sheep that get told what to say, do, eat, believe. Free yourself from the shackles of enslavement for the sake of your kids. -An4l Clamps
