Can your girlfriend sign your child's birth certificate?

Yes, but if the action is challenged by the biological father the BC and the custodial rights to the child can be altered.

Technically some might view such an action as fraud. However, if it is done with good intent there would be no legal repercussions but possible civil ones as noted above.

How does a biological father sign over his rights to a child if he is not on the birth certificate or has DNA test proving to be the father?

He has the right to petition the courts for a determination of paternity and, if he is the father, the right to pay child support and petition for visitation.

How can your son's father sign his birth certificate if he wasn't there at the birth?

You don't have to be the real father to be on a child's birth certificate. You would just have to sign a paternity affadavit, in which you are assuming all legal responsibilities to that child. You would talk to the mother about adopting the child and go through that process--if you are married.

You are the father of your son and he already has your last name you were present at the time of birth however you did not sign the birth certificate how can you add your name?

first of all you just need to walk or drive your butt down to the hospital (with the dad of course) force the dad to sign the paper and change the last name but it would probably be easier to take his butt to court ! ;)

Can a father legally add his name to a birth certificate?

You can put another man's name on the certificate, however if you are trying to collect child support from this man he has the option to prove that it is not his biological child with a DNA test. He however only has a limited window to have a test done, failure to take the test and prove that he isn't the father by default means he accepts the charge of being the father paying child support.

Does the father have to sign the birth certificate in the hospital?

I know that in the state of pennsylvania, the father must be present to sign the babies birth certificate in order for the baby to have the fathers last name.

Is there any way you can get the father name taken off the birth certificate?

Perhaps you could if he relinquishes all rights or if your new husband adopts the child. However, even if you do somehow remove the name from the certificate, the fact is that he is still the biological father. Better to move on in life; fixing this will not make a large difference to the situation in the end.

Where do you get a birth certificate from?

If you have a social security number you could go to your local social security department and possibly find out what state your s.s.# was issued in. You then could notify the capital of this state and they would be able to assist you in obtaining your record of birth. Some states charge a minimal fee for getting a copy of your birth certificate. If you have no social security card, I would contact your state capitol for a copy of your birth certificate first then go to your social security office with the copy of your birth certificate to obtain a social security card. I hope this helps you.

It is possible to register the birth certificate of a newborn baby if the FATHER doesnt want to sign on it and doesnt want to use hes SURNAME?

Yes, you can. Most states prohibit naming a father without either a marriage license or a DNA test. Of course, if you are unmarried and sue the child's father for child support, the father's name will be added to the birth certificate. Also, in almost all child support cases, the child's last name is changed to the father's last name.

If an unmarried father signs a birth certificate does this give him parental rights?

An unmarried father must establish his paternity and arrange for a custody hearing if he wants custody.

Generally, if the parents are unmarried the mother has sole custody and control in most states until the father can establish his paternity. Remember, a child's mother can always be identified by medical records. Since the father didn't give birth and he was not legally married at the time of the birth he must establish his paternity by signing the birth certificate at the time of birth (waiving DNA testing rights) which must be done with mother's consent. If he doesn't sign the birth certificate then he must seek another way to establish his paternity and that is done through a DNA test.

A paternity test can be arranged through the court. Once paternity has been established the father can request visitations, joint custody, full custody or the court will set up a schedule of regular child support payments for the child if she is to remain in the custody of her mother. The court will schedule a hearing and issue an order that is in the best interest of the child.

Do you have to list the father on the birth certificate?

no you dont. i actually just looked at mine like 2 minutes ago and only my moms name is on there. Because they know for sure which women the kid came out of but to find out for sure which man it was they have to get DNA from him so its easier just to have the mom sign the paper because they know for a fact that she is the mother.

If the babies father is not present at the time of birth can he still be put on the birth certificate?

As of April 1, 2011, the U.S. Department of State requires the full names of the applicant’s parent(s) to be listed on all certified birth certificates to be considered as primary evidence of U.S. citizenship for all passport applicants, regardless of age. Certified birth certificates missing this information are no longer acceptable as evidence of citizenship.

So what if both parents are not known such as

a single mom who did not name the father on a birth certificate or an adopted child whose birth parents wish to remain anonymous?

AUSA Today Travel Articleposted April 6th provides an official answer from a State Department spokeswoman who e-mailed:

“The Department recognizes that some passport applicants will not have two parents registered on their birth certificates due to circumstances such as an unknown father or a single-parent adoption case. In these cases, a passport applicant may submit a certified copy of a birth certificate listing the complete name of the registering parent. Regarding two parents adopting a child, the parents may amend the birth certificate of their child to reflect both of their complete names. Though requirements differ slightly across the country, states generally make it easy to amend a birth certificate to list adoptive parents. In adoption cases, the Department will also accept the certified copy of the child’s original birth certificate as long as it is submitted with the certified copy of the adoption decree indicating the name of the child and his or her adoptive parents.”

Can a father give up rights if he signed the birth certificate?

It matters if the father is named on the certificate as the father. If so, then he has as much rights as the mother. But in a court of law you might find the mother has a little more.

Only if the mother has a problem will the father get custody. The law see's the mother

as the one who the child should live with.

Does a unwed mother have custody of a child if the father is on birth certificate?

The unmarried father must file a petition in the family court to establish his parental rights legally. Once established, he can request visitation rights or custody through the family court. If the mother retains custody he will be granted a visitation schedule and will also be subject to a child support order.

By not establishing his parental rights legally at the time of birth, the unmarried mother has freedom of movement. Once she moves with the child to another state it will be much more difficult and costly for the father to pursue his parental rights.

What rights does a father have if not wed to mother and not on the birth certificate but the child carries your last name?

none

none, becasue you are not on the birth certificate you need to establish paternity first. if she doesn't ask for aide from the state or money from you the courts won't really make her establish paternity, without a court order you have no rights, who ever has custody of the child is the one with all the rights. She can keep you from seeing your child indefinitely and basically move out of state. You have to file an order to show just cause. you can do it by yourself with the self help section on the Superior Court's web site. Orange county has the best self help section. They give you packages with instructions on how to fill them out and all you pay is the filing fee which varies but is around $ 360.00. You ask the judge you want to establish paternity and be NICE because he doesn't have to rule to have it done if he doesn't want to. I just went through this with my fiance and becasue she didn't put his name on the birth certificate he didn't rule establish paternity because she was self sufficent. But when child support got the paper work we found out she was on aide the time before she got a really good job and they wanted their money back so now they are pursueing it and making her go take a blood test. it's all about the government getting paid back and if they aren't owed anything it's really heard to make her show who the father is if she doesn't want to.

Can the father sign birth certificate if woman is married?

If you're in the US, no, she cannot just list him on the birth certificate without him being involved in the process (he normally has to sign a separate form acknowledging paternity)

Only the father can sign his name to the birth certificate, but he is able to do so regardless of whether they are married unless the mother is married to someone else. In that case the husband of the mother would have to be ruled out as the child's father before the biological father can sign.

How do you find out if father is on another child's birth certificate?

You could check the hospital where you were born to obtain a copy of the Record of Birth Certificate they placed on file. This is the one with your foot prints. It would not be destroyed with the official record kept by the state.

When does a fathers name get put on a birth certificate?

By requesting a Paternity Test either in court or through your local county child support division. Once the test comes back positive, if it does, then you will receive paperwork to send off to make an amendment to the child's birth certificate.
