WOW That's an odd question? I have to assume that you don't have the CD cover or else you would know who played drums on it I guess. Hopefully you purchased a legal copy. ahem!
Yes Randy Paine a drummer originally from the Boston area who now resides in Los Angeles played drums on the Cynical Swing CD you're asking about. The CD has been referenced in a few places online over that past couple years thanks to it being mentioned in a 2007 Wah lesson (a wah is a guitar effect) given by a very popular Los Angeles guitarist named Jeff Fiorentino on his very popular website Jfrocks.com I guess after that a few other people got their hands on some of the songs from the CD. I believe from various Facebook sources or maybe a band member's myspace account, or maybe it was actually for sale somewhere online who knows.
The fact that someone would ask a question about a CD that as far as I know you can't even purchase anywhere is really weird. I only know about it because after Jeff's lesson on the wah topic I searched Google to research the CD.
Since I'm in the music business and misunderstandings happen I have to point out that there was no copyright infringement on the part of Jeff Fiorentino, he simply gave credit to where the wah example he used came from. Fans know he does that all the time. It's interesting though that while Guitarist Jeff Fiorentino has no affiliation with the CD he it would seem knows or knew a couple members from the band and referenced a small 10 second piece of it during a video lesson segment he did on proper use of a Wah again back in 2007. Whenever a big whig in the guitar online community like Jeff Fiorentino references something other sources pick up on it. Someone got a really great plug there back in 2007 and I sure hope they capitalized on it.

Tony and another member were let go and the "official" statement going around is that is was simply "time for a change". A lot of people were upset about this and as far as I know no reason has yet been given aside from this. Tony has a FB fan page with a lot of supporters. He is currently playing with a band made up of some ex pro musicians from other bands ( such as Brooks and Dunn ) and if I am not mistaken the band name is Cottonmouth and were last playing in the Lexington, Kentucky area and were working on a possible record release.
