No. If you've completed your military obligation, there isn't anything that they can do to you. If you have a pension and/or benefits coming to you, those can't be touched either. Absolutely not! If you were good enough to be in the service and served your country it shouldn't matter if you are gay, black, white, yellow or any other color or sexual preference. Thanks for just being in the service! That's something to be proud of. If the person were pre DADT, yes, he or she would have committed a felony by deliberately witholding information on the Enlistment Contract (DD-Form, 4). If the person were post DADT, then the answer would be, no. The DD Form 4 has no question mentioning sexual preference and to do so is against the Privacy Act. Just looked up the DD Form 4 and it's quite a simple form and asks few questions. As far as the DADT things are being changed on this one, but not yet into effect. Before Clinton's "Don't Ask Don't Tell" policy was implemented the enlistment form paragraph #3 read: "My acceptance for enlistment is based on the information I have given in my application for enlistment. If any of that information is false or incorrect this enlistment may be voided or terminated administratively by the government, or I may be tried by a federal, civilian or military court and if found guilty punished." Prior to Clinton's DATA policy (it is in effect),potential recruits were specifically asked on the enlistment form if they were homosexual, privacy laws do not apply to the military for security reasons. After the DATA policy was implemented, the enlistment form was amended to avoid asking direct questions but rather precisely define what was not against military policy such as possessing gay literature, attending gay functions, etc. There is still a military law concerning the discharge and/or punishment of any military personnel found guilty of consensual sodomy. Military persons who are openly gay are still being ostracized and physically attacked with little if any action being taken against the perpetrators. A very good friend of mine who served before DATA and finished his tour of duty was foud guilty of perjury on his enlistment forms and a civil cout ruled he committed a breach of contract and was not entitled to his college tuition and other benefits. Needless to say has been appealing the ruling with the assistance of the SLDN.
