If you receive disability from your job and recently after 3 years received social security disability can your long term disability take your back money and decrease your monthly benefit?

No. Edited to change answer to YES! If I understand you correctly, you are receiving LTD from an Insurance Policy you had through your Employer or bought yourself. Right? And you were just approved for Social Security and received your backpay - from the time you filed to the time you were awarded. Right? And now your LTD Company is asking for most of that money and have now decreased your monthly benefit by the amount of your Social Security check. Right? This is all VERY LEGAL AND NORMAL! Your LTD company pays you a certain amount - mine pays me 60% of my pre-tax income. Let's just say that is $1,000 (it isn't) And they have been paying you that $1,000 for 3 years. Now, Social Security is going to pay you $700 a month. And they gave you backpay for the past 2 years. Then your LTD company is going to start paying you only $300 a month - $1,000 minus $700 SS Check. You will NEVER receive Social Security Disability of $700 PLUS your $1,000 LTD check. I would assume you would see why this wouldn't happen, right? And your LTD is also entitled to their $700 a month for those 2 years that Social Security paid you for backpay. So you will owe them $16,800 ($700 x 24 months) So the original answer of NO is wrong. If this is the scenerio you are presenting anyway.

If your spouse is in a nursing home and you have no insurance how much is the other spouse allowed to keep when money runs out?

In the US if Medicaid is paying for the nursing home, this falls under the state laws applicable to Medicaid. It will vary somewhat from state to state. Information specific to the individual circumstances would be available by contacting the state Medicaid office. An additional source of information about this, and contact information for the state program administrators, should also be available from the social workers, the admissions or financial departments, or the Administrator at the nursing home providing the care.

Can you find a person's place of current employment with a social security number?

This is illegal unless it is to do with creditors, etc.! * No. Social Security numbers/records, are protected by US federal law. The creditor does not have access to the individuals employment history through the SSA nor do private individuals. It is illegal to ask for social security numbers?

There are a number of situations, such as when you are applying for a job, or opening a bank account, when you are required to give your social security number. There are other situations in which it would not be appropriate for you to be asked for your social security number, such as, when ordering a hamburger. Nonetheless, it is not illegal to ask for a social security number - people can pretty much ask anything they want to ask, since we enjoy freedom of speech. If you are asked for a number and you don't wish to give it, you don't have to.

When your disability benefits convert over to regular social security is the amount the same more or less?

This depends on a variety of factors. Is your disability through an insurance company or a temporary ss disability check? If it is through an insurance company you can almost guarantee that SSDI will be less unless you had a pretty bad insurance policy.

If you're on temporary assistance with SSDI and go to permanent then it's very likely your checks will go up a bit.

The main factors in private insurance are your amount of coverage and your pay level. The main factors with SSDI are age and amount you paid into ss.

Hope this helps!
