The company you originally owed has decided that you are not going to pay them. I don't know why; it isn't important. The important thing is they have done what is called a chargeoff, they have put a black mark on your credit, but essentially you are a dead account to them. So these company go to the financial institutions and they buy all the bad debt for pennies on the dollar. Now they can start harassing you for what is now their debt. If they intimidate you into more than 5 bucks on a Cadillac, they've probably made 4 dollars profit. Now, they bought what is in reality a non-existant debt, so they get everything they deserve, which is you being tough enough to just throw the mail that comes saying "Final Chance to pay Before Proceedings" and Mister X, wouldn't you love to get your credit back for only 300 bucks?" For one thing, you aren't going to get your credit back by paying them dollar one, because they did not report the debt in the first place. I seriously advise you to get a phone with Caller ID, and screen anyone but your family. THey will probably hit you pretty hard initially while you are fresh meat, but eventually they will get the message. Then they'll sell your account for pennies on the pennies to an even nastier bunch. Don't answer the mails, and don't get involved on the phone EVER, because they will threaten you and promise you everything. Eventually it will all stop as they move on to softer targets. Usually, if you have the strength to pick up the phone and say I have put this into the hands of my attorneys; you should call Paul Smith at Smith, Smith and Smith in all matters relating to this AND PUT THE PHONE DOWN ON THEM BEFORE THEY START ASKING HOW COULD YOU BE SO MEAN TO THEM WHEN ALL THEY WANT IS TO HELP YOU OUT. That should do it. Just use a real number and a real attorney in case they look it up on the web to see if you are bluffing, but usually they will move on. Just never get involved on the phone with them trying to "make your best deal." your best deal was when the original note holder charged you off.
