Can a person receiving workers compensation benefits file for a tax return?

No you won't likely be receiving a tax return in the mail like you have in the past. The IRS is getting away from providing paper copies of tax returns. You pretty much have to do it electronically these day.

HOWEVER...

If what you are asking is whether you will get a tax REFUND while getting workmens compensation then there simply is not enough information provided to give you an accurate answer. We'd need to know what other income you had as well. We'd need to know HOW MUCH you received in WC. We'd need to know your filing status. We'd need to know how many Exemptions you qualify to claim. All of that just to be able to determine whether you had any Taxable Income or not. Then we could likely determine your Tax on the taxable income. Then we would have to see if you qualified for any "non-refundable credits" that could be used to offset the Tax.

Then we'd have to determine if you were liable for any additional taxes. After all that then we would know your Total Tax figure. We could compare that against your income tax withholdings plus any "refundable credits" you might qualify for to find out if you are going to qualify for a REFUND.

It's not an EASY process and can't be answered just "off the cuff".

What is code 8809 in workers compensation?

If I have primary insurance through my work and had secondary through my husband's work but he was laid off can I still use Cobra as a secondary insurance or is Cobra only if you have no insurance?

That would depend on if your spouse's coverage is group or individual coverage. If it is group coverage offered by your spouse's employer then NO. Cobra regulations specifically say that you are not eligible if you have other employer sponsored group coverage with one exception. That is if the other coverage includes any pre-exisitng conditions clause that would deny you coverage for that illness/injury. If you have no pre-existing conditions or the pre-ex caluse does not relate to you (ie. pregnancy is a pre-ex but you are not pregnant) then you are not eligible.

If the spouse's coverage is individual coverage and not group you are still eligible for Cobra.

How do you become a title agent?

Become a Title Insurance Representative

In some states, you must be a licensed title insurance producer in order to sell title insurance products.

Check out your state's Department of Insurance website for education and licensing requirements.

Most people who sell title insurance have some mortgage, real estate or legal background; however, it isn't a requirement in most instances.

A Title Insurance Rep is a representative for their company who, in turn is licenced to sell title insurance. In a nut shell, a title rep schmoozes their clients. Being a Title Rep is one of the only sales positions that I can think of where the product you are representing has little, or no variance in quality or price. So, the main job of a title rep is to differentiate themselves from their competitors and this is done by building client relationships.

A title rep typically has a sizable expense account, used primarily to help their potenital clients (Realtors and Mortgage Brokers) build their own business (marketing materials are a typical expense provided by a title rep to the client). The client relationship can be fostered by talking over dinner or a group during happy hour. Often a Title Rep will take the whole office to an event just to build that relationship. By establishing relationships with Realtors and often Mortgage Brokers, these clients become friends... And everybody wants to do business with their friends!!

A Title Rep's income is based on how many individual orders come in from loyal clients (after all they have been wining and dining them for the past 6 months). An order is made everytime the client specifies that you (as the title rep) and your company will be providing the Title insurance on their specific purchase or refinance.

Ohhh HOW do you become one.... SORRY... Be very personable and outgoing. Then march yourself right into any title office, dressed very sharply and let them know you have done all the research in the world about being a title rep, and you would like to set up an interview. It's a sales position, so you must ask for the interview, then ask for the job. Be prepared, know the company... Also, ask a Realtor friend to hook you up. Remember, the title reps want to build relationships with the realtors so the the rep owes them lots of favors. Make this one.

COMMENT

Please note that RESPA regulates what can be spent as a gift or incentive while entertaining clients when it comes to the real estate, mortgage and title industry. It is typically $25.00 per person PER YEAR. Some of the above answers lead you to believe you can legally wine and dine your clients with no recourse.

Real Estate Settlement Procedures Act (RESPA)

RESPA Basics

What is RESPA?

The Real Estate Settlement Procedures Act was enacted in 1974 to prohibit unlawful inducements and kickbacks for the referral of residential settlement services that could unnecessarily increase the cost of settlement services to consumers as determined by Congress. RESPA has often been misinterpreted and the regulations are often unintentionally violated by those who provide residential real estate settlement services.

RESPA covers loans secured with a mortgage placed on a one-to-four family residential property. These include most purchase loans, assumptions, refinances, property improvement loans, and equity lines of credit. HUD's Office of RESPA and Interstate Land Sales is responsible for enforcing RESPA.

What is the purpose of RESPA

The Real Estate Settlement Procedures Act is a consumer protection statute for the purpose of:

  1. To help consumers become better shoppers for settlement services and
  2. To eliminate kickbacks and referral fees that unnecessarily increase the costs of certain settlement services.

What is RESPA Section 8?

RESPA has two main areas of emphasis: (i) giving consumers better advance disclosures of settlement (closing) costs, and (ii) eliminating kickbacks or referral fees that unnecessarily increase closing costs. The latter is directed towards the practices of various "real estate settlement service providers."

==Those entities include lenders, title companies, escrow companies, termite inspectors, insurance companies, and, of course, real estate brokers and agents.==

What is a RESPA Section 8 Violation?

Section 8 of RESPA prohibits a person from giving or accepting anything of value in exchange for the referral of settlement service business. It also prohibits a person from giving or accepting any part of a charge for services that are not performed!

Will insurance pay if a skunk sprays your house?

Skunk Inflicts Odorous Damage to HomeThe cost of a few bottles of deodorizers, neutralizers and sanitizers along with a good scrubbing will do as much as anyone else could do and it's likely far below your Policy deductible.

I'd just go spend a hundred dollars on a variety of cleaners and odor removers and then air out that area of the house as much as possible, throw out anything that was absorbent. Probably still less than the deductible. Not to mention the possibility of an increased premium at renewal time due to prior claims and a loss of any claim free discounts.

AnswerTo add, to that response, it depends on your insurance company. The standard exclusion under almost every homeowner's policy with regards to this: "birds, vermin, rodents, insects, or animals owed or kept by an insured".... Read between the lines- its not an absolute animal exclusion as original response suggests. Pull your policy and read it. AnswerSo, a skunk is not a bird, rodent, insect, nor an animal kept by you (I would hope), BUT, they MAY be considered "vermin". Now, I have had 2 clients with the same claim (skunk contamination), one insurance company covered it, but the other did not. The one that did not cover it felt skunks fell under the "vermin" definition. If your insurance company defines skunk as vermin, i would suggest you find a new insurer. Even worse, if they try to invoke the "pollutant" exclusion, fight them on it! The company that covered the skunk claim has a 5 letter name, begins with "C" and ends with "B"...

What is the List of dog breeds not covered by house insurance?

Most insurance companies will not offer you a policy if you own a Pit Bull, Rottweiler, Doberman Pincer, German Shepherd, or other similar breeds or a mixture involving any of these. Also any animal that has any bite history. The also want to know if you own any exotic pets. Most companies will deny your policy completely. I have only two that will offer you a policy but you have to sign an exclusion for animal liability. They will cover everything else except injuries due to animals.

If your dog mauls your neighbors cat will your insurance pay for the cats medical bills?

Yes, most Homeowners Ins will pay for acts that you or your animals are Liable for. Most Compainies also include a damage to property to others coverage, in the amount of $500. This is a goodwill coverage that is supposed to keep you from being sued for liability coverage. Call your Agent or Company Customer service and ask them about those specific coverages. Good Luck.. If they wont be helpful, call your state insurance commissioner and ask them. That will motivate them without "wasting 25 to 40%" paying a lawyer for coverage you already paid for once!.

Do pit bulls increase your insurance?

Home Insurance and Pit Bulls

The question should not be - will it go up? The question should be, will they insure you "AT ALL" any more? Most insurers these day avoid providing all risk home insurance coverage for owners of certain dog breed types.

Many Home Insurance Companies nowadays automatically exclude coverage for injuries or damages related to pets, especially certain dog breeds.

There are many pet owners out there who are confident that their pit bull would never injure a person. However, the statistics prove that they will. It's not the dogs fault, it was bred in and is simply endemic to the breed.

From an insurance companies point of view, it could be a pretty big liability to them and that is understandable, BUT I think they should at least do some sort of checking into it, like weather the dog has bitten anyone in the past or things like that, instead of just dropping it like a hot brick!

However, to clarify, almost all major insurance carriers reserve the right to withhold payment on any animal attack claim for the insured homeowner if the animal involved was either a pit-bull or one of the other 9 dog breeds on the standard list of breeds listed because of number of attacks on humans or other animals. This said, the owner will still be held liable and civil action in such suits can incur the sale of property to satisfy the claim awarded by the court. This is something to consider since many claims against pet owners after an attack may reach a sum of tens of thousands and perhaps hundreds of thousands of dollars. Or more.

Most insurance companies will ask, but never actually check.

Nationwide will insure your home if your pit-bull has passed the Canine Good Citizen program.

However, a standard waiver form may still be required which will release the insurance company from claims concerning animal or human attacks. In addition, since you have indicated to the agent that you do own such an animal, the insurance company can use that to cancel you at any time and to withhold claim payment for any animal attack issue.

Actually insurance companies always inspect a dwelling upon a new policy being written. You may not be aware of the inspection. Nationwide contracts out inspectors to inspect new insured dwellings and most times will preform inspections prior to renewal.

Note: You should always be up front and NEVER knowingly provide false or misleading information when it comes to an insurance contract. You are paying premiums for protection in the event of a loss. You don't want to jeopardize a claim with a misrepresentation. And no, Nationwide will not write a homeowners policy if you have a pit bull.

Will home insurance cover dog damage in home?

Yes. I used to work for an Insurance company in the claims department. It will be covered under the section "personal property" of your Homeowners policy. You will however have to pay your deductible. If the deductible exceeds the amount to replace the item, the company will not pay. If it costs more then your deductible to replace it, then the company should issue a check for the remaining amount. So if it costs $2000 and you have a $500 deductible, you should get $1500.
