Drugs and the Law

Though the laws that regulate and prohibit drugs are complex, ignorance of these will not exempt an individual from being prosecuted. The first US law on drugs was an ordinance which prohibited the smoking of opium in San Francisco in 1875.

How much is the alcohol tax?

This of course depends on many factors. The two most important one being how many guests will attend and will you be covering part of or the entire tab. For a wedding of 150 guests your alcohol bill on average would cost $1600, for $100 people $1000. Of course your wedding venue may charge you a different price per head, and this is only an estimate based upon the calculator below:

If names and dates are wrong on a search warrant is the search warrant still valid?

SEARCH WARRANTS are issued for addresses or specifically described premises. ARREST WARRANTS name a specific name. Which are you referring to? As long as a search warrant is served at the address set forth in the warrant it is immaterial what name appears on it. If it was an arrest warrant in what way was the name wrong? Spelled wrong? Gives their alias or street name? Gives a totally wrong name (i.e.: John Doe instead Jack Smith)?

What are the four elements to prove negligence?

Actually, there are four elements of a negligence claim: 1) duty; 2) breach of duty; 3) causation; and 4) damages. In short, if you breach a legal duty and cause damages to someone else or their property, then you may be held liable for negligence. Whether a duty exists in a particular circumstance is a question of law for the court and depends on many factors. For instance, the driver of a car has the duty to use reasonable care in the operation of that vehicle. Breach of that duty resulting in a car accident can make you liable to the other person for any resulting injuries or damages. So if you follow too closely and rear end the car in front of you, then you would be liable. This is because the courts have recognized the duty of every driver to pay attention and keep a safe distance. However, if you are a passenger and fail to warn your driver of stopped traffic up ahead, you would not be liable because the courts do not recognize a duty of a passenger to aid in the driver's operation of the vehicle.

It depends upon which state you live in, and what that state's statute about licensing or registration of hygenists says.

If a section of the licensing statute is titled "prohibited acts," and within that section the words "may not have been convicted of a felony" appear, a person may not become a hygienist with a felony record, UNLESS there are also words to the effect that the felony record could be sealed or expunged. Some states' statutes use the words "being found guilty of. . ." various crimes without specifying whether the crimes are misdemeanors or felonies.

Not sure where you are, but in NYS (where I am), criminal contempt in the first degree would be one of the following:

1) Not co-operating with being sworn and/or testifying in front of a grand jury as a witness

2) Violating an order of protection (either the B-order or the A-order; A-order is the full stay-away, B is a weakened version)--in the case of a B-order by committing one of the crimes prohibited within the order such as stalking, harassment, menacing, intimidation, or any other crime against the person named in the order

If convicted of driving with drugs or alcohol in your body you will be sentenced to up to how many months?

Drugs is a more serious crime then possesion of alcohol is...with drugs, illegal ones, you would go to jail considering on how much you have and if you've been dealing it or not. If not, most likely you'd be there for 6-8 months. If your arrested for DUI, you would go to jail, not prison, and depend on someone to bail you out. If not, you'd go for about a month, depending on if anyone was hurt/killed within the accident and the damage you caused.

Can a male cop search a woman?

Yes, you may be frisked or searched by an officer of either sex. They are searching you for weapons to protect themselves from harm or injury. IF an officer of your same sex is present on the scene then CUSTOMARILY the same sex officer will do the searching but there is no requirement in law that it MUST be done that way. On the other hand, for a full "custodial" search (as when being logged into a jail or other detention facility), full body and body cavity searches are usually reequired to be done by same sex officers.
