I am in the same situation. My fiance was here and left voluntarily and although USCIS approved my petition for a K1 visa, they denied his visa for having been in the US for over a year so they banned him for 10 years with a denial of obtaining any waiver or pardon until he completes the 10 year ban. I'm sorry to say but there are no options or only one. I do not believe there is an appeal process for denial of work visas. If your currently in the US and do not leave your only alternative would be to marry a US Citizen otherwise you are jeapordizing your ability to return to the US in the future if you over stay your current visa.
