According to the Employment Development Department, you are only eligible for unemployment if you are unemployed "through no fault of your own." If you were fired for gross misconduct, your termination is probably your "fault." Note that gross misconduct has to be something serious, like stealing or putting the company in jeopardy. If you were simply fired for being lazy, incompetent, stupid, etc., that generally does not count as a fault of your own.

However, you should file for unemployment benefits - or contact the unemployment agency - anyway as they will review each case individually. There is no downside to filing unemployment (do know that they will notify your most recent employer) and the worst that can happen is that they will say "no"! If they say no, you can still appeal.

Ok. I am going to get some feedback started, though I still do not have a definitive answer for you. Technically as in most any state if you quit you are not eligible for unemployment, that's why employers will make you miserable and tell you how horrible you are but they will not fire you for fear of having to pay. They will push you hard enough to make you leave so you do not collect. However, when I lived in Florida, the same rules applied and I was lucky enough that the social worker called me to tell me that I was denied since I walked out of the job. I explained that it was true, however, it was due to insubordination on my bosses part, explained the details and she told me no problem and sure enough I was able to collect. I am in a similar situation right now and am trying to do some homework regarding NY Unemployment and see if I should bother applying or not. I will keep you posted. What's your situation why did you quit?

If you work a "free lance" or "pt/temp" job, you must claim it with Unemployment. If the gross money you earned was more than what U.E. pays for the week, you will not receive a pymt. for that week. You must give all info. re: the co. who hired you for the job, date worked, gross pay. The week you don't get paid for will be added to the end of your U.E. time period. You won't lose it. Only problem: Unemployment sends forms to be filled out by the company that you worked for that that make it appear like the company hired you and it sort of freaks out the company so they don't want to use you again.

The answer is YES. President Bush passed the bill on June 30,2008. It goes into effect as of July 6, 2008.

The question is how many times did you call out? If this was a single occurence then the department of unemployment will likely see the termination as unreasonable and grant you unemployment. If however it was several occasions and a violation of the company's attendance policy it may be a little more difficult to collect but you would need to file the claim and see what happens.
