If you don't believe that you are at fault for the termination, file for unemployment and if they deny it, appeal. One of my relatives went through this situation. She was wrongfully terminated resulting in unemployment being denied when she filed. She appealed the unemployment decision, when they contacted her former employer, they couldn't find where she had been written up or had negative info added to her HR file. She was able to receive unemployment for over a year until she found a new job.

This can be followed by 33 weeks of "Emergency unemployment benefits" and that is followed by about 20? weeks of "Extended Benefits" unemployment benefits. Once you get past the initial regular unemployment benefits, you may need to report your work search efforts in their format every month to continue to get benefits. If you are able to collect COBRA with the ARRA benefits, these get impacted as you switch from regular to emergency to extended. There are also career search services and educational grants and exemptions you can get. Google New York State unemployment assistance to get the website / the right area and look at FAQs. Make sure you read the actual regulations because in my experience, the representatives give you wrong info on the phone. Whether you live in NYS or not makes a difference on how long benefits last and whether you can get more than 2 weeks extended benefits.

I believe this answer is slightly incorrect -- "Yes, you can. Under "Non monetary Issues" > "Disqualifications" item (f) on page 5 of the Related Link below, Social Security benefits are excluded from the disqualifying chargeable benefits you receive." As I understand it, people who live in Louisiana and Illinois and receive social security payments and are eligible for unemployment benefits will have money deducted from their unemployment checks. In illinois, half a person's weekly social security payment is deducted from that person's weekly unemployment check. Illinois AARP has made repealing the social security offset law a priority.

Yes you can, and only 4 state's offset your unemployment compensation by a portion of your Social Security benefits (Illinois, Louisiana, Utah, and Virginia).

YES. The two programs are different. Social Security is a Federal program that you pay into from your paycheck, as does the employer, and you are eligible to receive after you turn 62 (unless earlier due to being disabled, which is covered under a different part of the program). The longer you delay receiving Social Security the larger the monthly benefit you would get. The amount you receive depends on your age, how many 'quarters' you worked, and the amount of your earnings.

On the other hand, unemployment security, a federal/state program, administered by the state, comes from contributions paid into the program by the employer and the amount he pays in is a percentage of his payroll based on the employer's turn-over rate of employees (the lower the turn-over, the lower the percentage). This way the employer is encouraged to retain employees in order to reduce his costs. The employee, generally, receives unemployment benefits from the state's collected 'employer's unemployment contribution pool', IF he was laid off, i.e. reduction in staff, etc., or was fired without cause (not caught stealing, harassment, drugs, etc.), or other reasons not due to his own actions. Thus you can both draw Social Security while still working (as I had done) or if drawing unemployment because the reason for drawing both are different, from different government agencies, and for different causes.

I believe you can, if your employer reports it. But there is also (at least in TN) a 1 week waiting period for some reason. So if you think that over the next few months you may be off, lets say a week at a time, you need to get that first week out of the way. Then you can collect on future weeks off.

At least that's what I've been led to believe, something like that is going on where I work now.

In MA I asked that same question. "Now that I'm getting disability, I guess I have to stop unemployment." Answer: "No, they are completely independent." So I collected in both. Of course, you will pay taxes on both, so put some aside.

It seems counter-intuitive, since disability means you can't work and in unemploment you state you can work.

I think the reasoning is: If you read your disability rules closely, they acknowledge the possibility that you find some work that you can do, and since that takes job-finding time you still qualify for unemployment.
