Will you be detained coming back into America at US customs in CO for a warrant out for your arrest in FL for a misdemeanor probation violation?

In today's day-and-age, random checks of passenger manifests are being conducted. These checks may be somewhat dependent on what country the flight originated in. If a warrant for your arrest is found in 'the system,' there IS a possibility that you may be arrested, or at least detained, until the status of the warrant is detemined. As a realistic matter it is unlikely that FL will extradite you from FL for a misdemeanor BUT THAT CANNOT BE STATED WITH 100% CERTAINTY.

All US states and territories honor each other's requests for extradition - there are no 'safe-haven' states - It is impossible to know with certainty whether a particular state will choose to extradite you for a particular offense, or not, there are simply too many variables. It may depend, in part, on the offense and the seriousness of it, and/or how badly they want you returned - most states WILL extradite for felony offenses.

How do you defend yourself against false accusations of credit card fraud resulting in your arrest?

Hire a professional Lawyer who has a history with Credit Fraud cases, you'll want a lawyer with former experience with these types of cases because they can take up large lengths of time to prove your innocence, or from a single hearing with a few small documents showing where you've been in the past few months, recent connections with the person accusing you of the fraud, recent computer usage, and after scrutiny of your computers hard drive. Also, there is a form of fraud where you're framed for fraud. Your best bet is closely evaluating your credit documents and the people who you've come in contact the most in the past month or so.

How can you obtain a copy of an application for a search warrant that you feel was unreasonable and want to know the reason it was issued or what the probable cause was that was stated on the applicat?

The reasons for the search would have been included in the warrant which the resident(s) of the property would have received a copy. The terms of the warrant would also be made public at time of trial/hearing and to the defendant and his or her legal counsel. Such information is not available to those persons who are not directly named in the case.

Can they put out a arrest warrant for you before they attempt to contact you or pick up the car?

Not unless you have commited a crime. Being in default on a loan is NOT a crime. Repomen/women CANT arrest anyone. IMHO, attempting to scare someone into giving up a vehicle is the LAZY way to do it. It would be INSULTING to me if a so called "recovery agent" tried that on me. roosta NO you cannot be arrested for non payment of your car loan period!! I agree that recovery agents (repomen) cannot arrest you. They are not peace officers. However, some states have laws directly relating to failing to return a vehilce that was financed. Try this one one for size, ARIZONA REVISED STATUTES TITLE 13. CRIMINAL CODE CHAPTER 22. BUSINESS AND COMMERCIAL FRAUDS

Can a trespass warrant be issued against someone without probable cause in the state of Alabama?

It is not necessary to produce any "cause" or "proof' of anything. It is enough that the property owner simply does not wish to have a certain named individual enter upon his property. It is the property owner's right to determine who shall or shall not enter upon his property.

Is a no bill from the grand jury good?

It's good for the person the State is trying to charge with a crime! A "no bill" means the grand jury does not think there is probable cause to formally charge the person and send the matter to the court for a trial. A "true bill" is when the grand jury does approve of prosecuting that person for that crime. In Georgia, if a Grand Jury "no bills" a case, the DA has one more chance to re-indict it, but usually they will not. At least not for the same charges.

It depends on the amount the Illinois warrant is for and if it is for a criminal warrant or for a civil case. Depending on that, the arresting agency will contact the issuing agency and will determine if it is enough to go thorugh extradition.

There is a bench warrant out for the arrest of your son's father He doesn't drive and you know that w a bench warrant the police will not actively look for him What are the options?

Do not assume that a bench warrant is not actively pursued. If you know where he is (and assuming you want him caught) advise the police of his location (residence, hangouts, place of work, etc) so that they will catch him there.

Why write a judge before sentencing court date for family member?

Because often, when handing down sentences, judges take into consideration what's called mitigating circumstances. Mitigating circumstances are things which may reduce the family member's sentence. Examples of mitigating circumstances are abuse as a child which may have lead the family member astray, substance abuse that made him or her act different than he or she normally would and more importantly, other good deeds that the family member has done, such as provided for his or her children, been a great parent, done charity work, helped people, etc. If you can show that, even in spite of the crime for which the family member has been convicted, that the family member is still a contributing member of society, the judge may be more lenient with the sentencing. And although family members of the convicted person may have an opportunity to testify to these things at a sentencing hearing, putting information in writing for a judge to receive in advance of the sentencing hearing and put in the record is always a good idea because, for the most part, things are given more weight in the legal world when they're in writing. What's more, the earlier this information is received by a judge, the better. It'll stick in his mind as a part of the court record, rather than testimony that he heard minutes earlier which is more likely to be overlooked.

If you get pulled over with a suspended license and drugs are found can the police go to your house and search too?

Probably. If they can develop probable cause that you would also have drugs in your home, they can get a search warrant. No! One has nothing to do with the other. The License issued to you by the state acts as a, for lack of a better word, "promissory warrant" to search your vehicle. All States stipulate that driving is a privilege, and that telling a officer that he/she can't search your vehicle is punishable by arrest, and revocation of your "privilege to drive". On the other hand, Police CAN NOT use the evidence secured in your vehicle to search your house unless they witnessed you pulling out of your driveway and stopped you after you entered traffic. This does constitute "probable cause" but they still have to secure a warrant with their testimony to the judge before a search of the house can happen. Further, the drivers license "promissory warrant' does not cover the house, only the conveyance that is the vehicle. A lawyer fresh out of law school can blow the house search out of the water. Now, I don't condone illegal drugs, their use or sale, but the defendant has rights not to be infringed on.

Must an arrest warrant be presented before arrest?

Not in the UK.

Added: Also the same in the US. Mere knowledge, on the part of the officer(s), that a warrant exists is sufficient cause to place the subject under arrest.

How many weeks behind in the state of South Carolina do you have to on child support before a bench warrant can be issued?

The bench warrant is nothing to do with how many weeks behind you are, it is issued due to contempt of court which can happen at any stage in the proceedings, if you fail to appear for a hearing.

What would happen if you got stopped by police and have an outstanding warrant?

They will arrest you, you will go to jail and depending on what the warrant is for they will set a bond amount which you will have to pay before you can be released. If you cannot pay it you will stay in jail until your court date at which point your charges will either be dropped (not likely), you will be sentenced to more time or the judge will give you a fine to pay and credit you with time served and you will go back to jail for several hours to go through the release process. It is really in your best interest to turn yourself in by simply going to the jail and telling them you want to turn yourself in. It makes things alot easier and makes you look better.

Should you contact the court for a payment plan with a bench warrant on a speeding ticket Ticket is in TX Current residence is CA?

Only if you want to stay our of jail and keep your drivers license. You need to take whatever they offer you and be happy about it. I'm sure they will work with you to get it off their record but remember that your not doing them a favor as much as they are doing you one. They don't have to work with you but they will. They can just keep the bench warrant active until you get stopped again and you will be arrested on the spot.

Does a Texas traffic warrant expire?

Will California arrest you for misdemeanor warrants from Oregon?

In this day and age of budget crunches, it may seem unlikely - BUT - where the law is concerned, never say "never!" All US states and territories honor each other's requests for extradition - there are no 'safe-haven' states - It is impossible to know with certainty whether a particular state will choose to extradite you for a particular offense, or not, there are simply too many variables. It may depend, in part, on the offense and the seriousness of it, and/or how badly they want you returned - most states WILL extradite for felony offenses and crimes of violence.
