What is the policy of when a copyright for literature is expired?

: Research done by Ksmail and copied from the supervisor's forum:

An example of writing becoming public domain is "If" by Rudyard Kipling. : The work was created and first published before January 1, 1923, or at least 95 years before January 1 of the current year, whichever is later; : The last surviving author died at least 70 years before : January 1 of the current year; : If either of these are met a work becomes public domain. : The poem inthis example was written in 1910. This meets the first requirement. Kipling died in 1936 meeting the requirement of the second condition. (Note both do not need to be met just one)

Can you patent a receipe?

Yes you can. However, your recipe must be new, which means that no equal recipe should have been ever published or seen before wordwide (The patent authority is in charge to perform said review). Further, your recipe must have an inventive level, which means that if the same is similar to another one, it should involve advantages or improvements over every other recipe directed to produce the same product. It is very advisable that prior to present a patent application, a patent search is carried out, which will allow you to find out whether any similar inventions are already disclosed that would not permit the granting of your patent. The most cost/effective way to carry out all of these steps, is to hire a patent lawyer. if you are in the states, the biggest company and the one that i would recommend is Jones Day. They have a lot of experience in the matter.

Could you give me more info on Italian made 36 cal black powder pistol patent N engraved 16 may 1843?

It is most likely a Pietta ASM or Uberti made gun, there are many Italian BP manufactures imported to the US, many with no markings other than proof marks and serial number. Look at the on line auctions, like gun broker and auction arms to compare what you have to what is there, and get an idea of value too.

What is a franchise royalty clause?

A franchise royalty clause is a provision in a franchise agreement that requires compensation ("royalty") to the franchisor for the right to use the franchisor's protected, branded intellectual property (usually bearing a "TM" or an "R" or "S" with a circle around it which indicates a federally registered trademark, or "C" with or without circle that means there is a federally registered copyright). It can also be for something that is a patented product owned by the franchisor or one of its affiliates and is used in connection with the franchise.

For example, if you have a McDonald's franchise, you pay as part of your franchise fee royalties to McDonald's for use of all of their branded marks: the golden arches, the company name itself including the various shapes of the lettering, names like "Big Mac" and "Quarter-Pounder", etc. And when you are required to buy supplies, such as paper napkins and straws, that are required to have the McDonald's logos on them, you are most likely paying the supplier a royalty as part of the cost of the product, that they in turn have to pay to McDonald's again for the use of the logo and name on their products.

How do you follow the copyright law if there is no watermark or copyright symbol on it?

Signatories to the Berne Convention (which includes the United States) cannot require formalities. Before Berne, works were only protected if they were published with a copyright symbol and registered with the Copyright Office; since Berne, works are automatically protected as soon as they are "fixed."

If you wish to use materials created by someone else, even if they are not marked, you need their permission.

Is music from the 60s and 70s still copyrighted?

The answer depends on whether you mean sheet music or recorded music; they each have their own copyright and expiration. One may expire without affecting the other.

More than likely, yes. In general a US copyright is valid for the life of the holder plus 70 years, or 95 years from publication, if done as a work for hire.

However, the duration of a particular copyright can get complicated in the area of "music" and "sound recordings" of music that happened to occur in the 1960s and 1970s.

First, consider that federal copyright does not include any sound recordings made prior to 1972. State laws, however, cover sound recordings and those laws do not have any expiration (unlike federal copyright), at least not until pre-empted by federal copyright law in 2067. Thus, you must consider ALL pre-1972 sound recordings to be copyrighted until then.

On the other hand, the underlying "music", as a composition of notes (and maybe lyrics), may or may not be protected, depending upon when it was created or published, and if a renewal was filed. A related answer addresses the question of copyright duration in more detail.

How do you know who published a website?

To discover the owner/publisher of a website, you must do something called a Whois Lookup.

WHOIS (pronounced "who is"; not an acronym) is a query/response protocol which is widely used for querying an official database in order to determine the owner of a domain name, an IP address, or an autonomous system number on the Internet

You can perform a Whois Lookup on website such as: http://whois.domaintools.com.

To perform the Lookup enter the full address of the website into the text box and click 'Lookup'.

This will then display information about the owner of the website aswell as additional information such as a list of the top 6 countries visiting the website and the location of the website server itself.

Why are public goods misused by individuals who treat their private property with respect?

This is referred to as "the tragedy of the commons." The general idea is that it's someone else's job to take care of the joint property; as Aristotle wrote, "Every one thinks chiefly of his own, hardly at all of the common interest...everybody is more inclined to neglect the duty which he expects another to fulfill...."
