What if you are charged and convicted of a crime and serve the majority of your sentence why is your time on the streets not taken into consideration and the back up time not a factor?

If you are convicted of a crime your time on the streets does not count because you were not in jail. Your term "back up time" is not a familiar one. If you mean your jail time before your conviction, you did not receive credit for that because you did not ask for that. Your jailer or Department of Corrections can not give you credit for that, only your sentencing judge. If he left it off your sentencing papers, there is a way to get it put on them. It is called post conviction relief. You will need to look into it. You will need to get a copy of your sentencing papers and see just what they say. If you did not get credit for jail time, you will need to request it.

Does a parole officer have a right to call your employer if they are not assign to you?

Yes. Parole officers do not necessarily HAVE to be assigned to your particular case to supervise you. That would be like saying that a police officer can't make an arrest unless it is on the street he normally patrols.

Where do you find a job for a felon in Phoenix Az?

unfortunately the answer to your question is so far from cut and dry its not even funny . Arizona is a difficult state for a felon to live in , first off Arizona has this image of it self as being a "community of excellence". So they hand out felony convictions think candy on Halloween. Then when it comes down to dealing with all these people that have received these felonies . Most of the state shuts the door in their faces, No staffing agency's will deal with a felon , almost all Apartment complex's will deny a felons application to live there, and almost all good paying secure employers wont even consider interviewing an individual who has been convicted . I speak from 100% experience as I am a felon living in the state of AZ in the east valley . I received a felony conviction at the age of 17 after being charged with a crime at the age of 15 that I did not commit . I was made an example of by the city I was living in (Gilbert) so they could prove to the residents they were a force to be reckoned with . My case was a terrible ordeal for me and my family . I am now 29 years old and after getting out of prison in 2002 after a year stay I haven't been able to hold down a good solid job in over 11 years . See a big problem for "us" "felons" isn't just finding a job it's keeping one . I can explain , see a lot of employers out there take advantage of us , because of the whole "you need us we don't need you" way of thinking . We are treated poorly , made to work all the bottom end stuff despite experience and skill . In some cases I have seen employers threaten people who were still on parole/probation that if they didn't work overtime for no pay or no overtime pay they would call their P.O and lie to them etc. It's very hard for us , now to answer the question more directly , fast food is a decent option for a felon, as well as window washing . Selling Auto Glass can make a person some pretty good money . If you can get lucky installing Auto glass is an option too if companies are hiring don't try Safelite they wont hire felons . try Omega auto glass, Auto Glass Shop , and other smaller companies . Taxi driving is also another one . restaurant dish washer , if you can beat an illegal alien to the punch same rules apply for construction . its unfortunate but most places will hire an illegal before a felon . well I hope my answer was helpful and informative for some. God Bless

Can ex felons become flight attendants?

Most rules prevent convicted felons from obtaining such jobs - but it does depend on the nature of the crime and other factors. Not all felony convictions automatically disqualify someone from employment. But under the standards of Homeland Security there may be newer problems I do not know about.

TSA and homeland security have made it impossible but you can try, look on an airlines website and check out the minimum qualifications

Is questioning an inmate while in jail legal?

Not only is it legal, it is common practice. It is even common practice to put an "undercover" law enforcement officer in a cell, masquerading as in inmate to gain more information.

If however the inmate requests to not speak without his lawyer present, anything gained after that point is potentially "Fruit of the poison tree."

Can you get in trouble for someone living in your home has a felony warrant?

You're probably thinking about when people talk about harboring a fugitive. If the person has warrants for something like an unpaid speeding ticket then no, you can not get into any trouble for living with them.

Can a probation officer drug test spouse not on probation?

Probation officers have different powers in each state. Here in Louisiana, felony probation officers are fully commissioned POST certified, gun toting police officers with full powers of any police officer. You can get into probable cause issues though. Not only is every state different, every judicial court system within the state seems to lean different ways in it's interpretation of the laws.

Okay, to simplify this: yes, in some states POs are law enforcement officers. In all states they are representatives of the state and court officers. As such, any activites in which they engage with others who are not under their supervision falls under the Constitution. That is, without very specific probable cause or a warrant, they have no search or siesure authority over anyone.

If confronted, say nothing, simply do not speak, and call an attorney.

Can a convicted felon work where controlled substances are kept?

It's quite possible that some jurisdictions will have laws addressing this - but that is why employers are so diligent in checking criminal backgrounds - to avoid this type of possible conflict.

Is it a violation of juvenile probation if juvenile is arrested while on probation for unrelated disorderly conduct charges that were placed prior to the start of his probationary period?

Check with your probation officer. You have to tell him, anyway. It depends on what your conditions of probation state. In Tucson, there is a condition of probation that states you must report any contact with law enforcement. Failure to report contact would be a violation. Your best bet is to be upfront with your PO before he/she finds out, which they will. If the PO believes you are trying to hide or lie about this, it will only make it worse. Good luck and stay in school.

What is society's view on prisoners?

I know how I feel about it. I participate in Society, I am not the whole of Society. Prisoners should have rights too. Yes, they commit crimes, some worse than others. Why do they commit crime? What lead them to that decision? Is it drug and alcohol related? There really is no excuse for crime, however, if you dig deep enough, you will discover a reason for the crime/s. There is always a reason! I agree that they have an education whilst in prison. Any assistance / support to help them make better choices on release is a positive. We need more support for prisoners when they are released. A parole officer is not support!

Can your probation officer search your roommates room in your house?

What is the statute of litations on parole violation in Texas when a person is in another state but paroled by Texas?

There is none. Absconding is an open felony. If not apprehended, you are a fugitive. Look at the case of the woman who absconded/escaped from the Michigan DOC 20+ years ago and was apprehended in California earlier this year. Look at the case of Roman Polanski. If you abscond or escape, you will be listed as a fugitive, you will be captured eventually, and you will do the time. Consider whether you want to do the time now or when you are 70 or older. Your best bet is to face it now and be done.
