U.S. OASDI social insurance system funded by FICA payroll taxes and originally created by the Social Security Act of 1935

3,984 Questions

Why should the government keep social security?

The biggest argument in favor of keeping Social Security is that since 1935 all workers in the U.S. have been funding Social Security through the Federal Insurance Contributions Act (FICA) taxes that are deducted from their pay with the promise that some day it will be their turn to collect payments, which will be funded by the FICA taxes collected from the next generation. The reason Social Security is failing is that in 1935 they did not anticipate that the ratio of retirement-age people to working-age people would increase as much as it has.

Is federal income tax and Old Age Survivors Disability income tax taken out of one's social security check?

OASDI is not taken out.

Income tax is taken out on request only. Contact the Social Security Administration if you want tax to be withheld.

Whether or not you ask for tax to be withheld, you may be liable for tax on your SS payments. That is computed when you fill out your Form 1040 at the end of the year. If you do not have sufficient tax withheld or make estimated payments, you may be subject to a penalty for underpayment of estimated taxes if you owe any taxes.

Can you levy properties of employers who failed to pay social security taxes?

You can not. The Federal Government does this every day. Tax liens are placed and property seized all the time for this purpose. You really can not get away from paying the full tax for SSI.

Does it make sense to accept a 50000 offer from worker comp and then apply for social security?

Yes. The workers comp settlement is compensation for past injury and loss of earning capacity, and is a finite amount. Social Security disability is for inability to work in the present and future and may be a permanent monthly stipend.

Can a person receiving Social Security Disability benefits sue for 100.00 a day for 10 weeks for pain and suffering in small claims court in California?

Yes, the issue of a citizen collecting SS benefits, public assistance or private disability/pension is not relevant when it pertains to a civil suit of any nature.

What can I do if my moms name is misspelled on her life insurance policy with the correct social security number?

The insurance policy should have the company's name on the front cover. Get the number and call the national home office number, or the local office if you can find it. An agent will prepare a revised copy.

Can you receive ss benefits and military benefits at the same time?

In general, you may receive both military and Social Security benefits at the same time.

What can you do if you know someone is working and getting social security disability?

It can be reported by mail, internet or phone (1-800-772-1213.)

First, know the facts. A person collecting social security disability can work up to 9 months during a 36 month period with some offset.

Do your research on those rules and make sure you know what you are talking about. You also need to know the facts about the person's situation and the odds are you do not. Karma will come back to you.

Most people would rather be working than collecting disability. Disability is a pretty paltry sum. It's hardly enough to live on. Perhaps you should encourage the person to work and become independent enough to get off disability.

If you were married after being with your first husband for ten years can you get his social Security when you are 62?

If you were actually married for 10 years (not just together for 10 years), then you're eligible to draw off his social security (he still gets funds too). However, if you remarry prior to retirement, then you are no longer eligible to draw off his social security, unless your later marriage ends (death, divorce, annulment).

Do you have to pay income tax on social security income?

Yes.

However, it is subject to a very complicated formula that takes into account what your total income is and takes into account certain non-taxable income such as municipal bond interest. And the whole amount of your Social Security payment is not taxable. A maximum of 85% of your payment is taxable. (Don't misunderstand this statement, the tax rate is NOT 85%.)

If you really want to know if your benefits will be taxable, fill out the Social Security Benefits Worksheet on page 27 of the Form 1040 instructions:

What should you do if your ex-wife uses your Social Security Number without your consent and it results in a judgment being entered against you?

I agree with the answer below but would like to add my 2cents.If you two were still married but not living together and she had "your power of attorney", then you should be calling to make payment arrangements. You could fight the judgment --get your own attorney, start putting any and all paperwork that proves she did this on her own. Like separation papers that discuss who is to pay what bills, that there is no power of attorney, copy of the application with a signature that doesn't look like yours at all. Go to court and see about getting it removed. If all fails and you have to pay, then file a civil judgment against your ex-spouse to recoup your money.Good Luck!

AnswerIf she lived with you when it was opened or had the account opened during a time you were both together, it will be pretty hard for you to prove to the creditor that you weren't aware of the account and it will probably be deemed a marital asset. I would see if she is willing to take responsibility and if she is then contact the creditor and let them know. They can have her sign a letter of responsibility and remove it from you and put it on her. If she is not, then you will probably have to take her to civil court to dispute it.

First of all it is a federal felony for anyone to use another person's SSN without authorizaton, that includes a spouse.

Secondly, it is difficult to understand how a judgment could have been obtained without the person being aware they were being sued.

When a lawsuit is filed by a creditor the SSN and the name must match before the suit can go forward.

If somehow this slipped through the legal system, the judgment is invalid and the innocent person can file a motion to have it lifted.Once that is done, inform the credit bureau of the action by written correspondence containing a copy of the judgment dismissal.

All misuse of SSN's should be reported to the Social Security Administration.

When being emancipated can a minor use a Social Security check from the death of a parent for personal income and the money to take care of self?

It is a source of income that can be used to show the ability to take care of one's self. Of course that check alone isn't enough to support a person.

No, the Social Security System was started by Franklin D. Roosevelt in 1935, as part of "The New Deal".
