Define what intermediate sanctions are their purpose in the criminal justice process and their function as a sentencing alternative?

Intermediate sanctions are criminal sentences that fall between standard probation and incarceration. Intermediate sanctions can include house arrest, intensive probation (i.e., probation with more conditions beyond the basic conditions of standard probation), boot camps, electronic monitoring, and drug treatment programs. Intermediate sanctions serve a dual purpose in the criminal justice system. First, granting intermediate sanctions over incarceration helps reduce overcrowding and eases the burden on our nation's prison system. Second, it helps to reduce recitivism by targeting the behaviors of the defendants that led to the crime to begin with. For example, if a drug user is afforded the opportunity to attend drug treatment rather than prison and is successful, it is less likely that s/he will commit future crimes like possessing narcotics, and even selling narcotics or participating in various theft offenses to support his or her drug habit. Intermediate sanctions can be an effective tool if used appropriately. Individuals who are actually interested in making positive changes in their lives can benefit from the additional support; in turn, society benefits from having potential threats to the health and safety of others transformed into productive citizens. Unfortunately, it is extremely difficult for judges to weed out the defendants who want to change and the defendants who are merely looking for a "get out of jail free" card. It seems, however, that the risk is worth the potential for reward, especially if judges reserve these intermediate sanctions for non-violent offenders who are less likely to injure others while out on release. After all, if they reoffend, defendants given the benefit of intermediate sanctions will most likely be facing a hefty jail sentence if they violate their probations, giving them an incentive to stay on the right path and giving the justice system recourse if they fail.

Can parole board take away street time from full term release date?

While your question is unclear, the answer is irrefutable for all questions related to the parole board:

The parole board has ultimate authority over the parolee and nearly every aspect of his life. If the parole board choose to, for instance, revoke your parole because you are directed to stand on one foot and bark the National Anthem like a dog and you refuse, you have only one recourse...return to prison. Once this is understood, and the parolee determines to "Lay Down" and stay off the radar (by simply living right) the problems encountered with the parole office will be dramatically reduced.

You took a sentence of 5 year felony probation and violated will you spend your time in a state prison or county jail?

It depends on the original sentence. If the original sentence was greater than one year and one day, your will serve your time in a state penitentiary. If the sentence was less than one year, you may serve it in a county jail, but the judge could mandate prison.

What does lockdown mean for a parolee?

"Lockdown" is a prison term generally meaning confinement for the entire facility for all inmates in their cell, room, cubicle,or bunk. It is a means of control used by prison officials to maintain order when there are heightened security concerns.

Lockdown to a parolee could mean essentially the same, only with the obvious difference being a parolee is not in the prison environment so would be required to stay within the confines of his residence, room, or perhaps a temporary stay at a local jail or other corrections facility.

Can probation be violated in SC by going to jail on a warrant from before your probation period?

It's impossible to tell what is in the mind of a sentencing judge, but it is entirely possible that you could be remanded to jail. It's very possible that IF the court had known you were wanted on an outstanding warrant at the time you were sentenced to probation, that you may have never even been offered such a lenient sentence to begin with.

Can a parolee own a dismantled gun which is missing pieces and cannot be fired?

Can he? Yes. He can also be charged with felony firearms and be sentence to five years of state prison or ten years of federal prison for being in close proximity of any component of a firearm, including discharged or undischarged rounds.

For instance, I personally know a man who was convicted of felony firearms for being in possession of a dismantled pistol that was in a locked box in the locked trunk of his son's car, when neither he nor his son had the key to the locked box in their possession. He served four of five years.

Will probation end if someone flees?

Your sentence didn't end. Your sentence WAS probation and you escaped it. You NEVER completed your sentence. Sort of like escaping from jail and running away. The best thing for you to do would be to contact the court that sentenced you and determine how best to address this because, like it or not, this WILL come back to bite you - usually when you least expect it AND at the worst possible time.
