You will do what is called a Voluntary Reposession. Basically what this means is you have given the car back to the lending company on your own free will, HOWEVER, you are still liable to pay for the vehilce. Most places will attempt to sell the car for what the book value is, if you have negative equity (owe for than its worth) and they are unable to sell it for what you owe you may still have to pay the balance even after the car has been sold. Of course the biggest down fall to this is it still gets marked on your credit report as a default and reposession.

-I hate to disagree with the above answer, but I own a repossession company that operates in WA, ID, and OR. This would never stop us. The reason is that we are hired by the lender, they will pay for the repossession. The first answer may be refering to a stay te that I do not operate in, or some subtle point of law that I'm unfamiliar with. The best advice is to call you lender and try to work out how you can get your car back. If you cannot work with them try contacting a company called LEAP financing, they finance cars that are in repo.

Hmmm, that's a tough one. But as far as I know, what he did IS legal unless he did actual damage to your door or anything else. Most of the time they either use a key from the dealership or get the car on a tow truck. In other words they would really rather not deal with the owners. So the fact that they knocked on your door at all is odd, unless they needed you to open the garage or a gate or something to get to the car.

The repo company can take the car from anywhere they want with the exception of a boot on the vehicle and/or the vehicle is in a locked property such as behind a locked fence surrounding the property or locked inside of a garage. If you do not let the person onto your property with a locked fence surrounding this is a voilation of the law and ofcourse YOU can have them arrested on the spot.
