This site really needs to put a "state" field in the ask a question thread.....it depends on your state. Some states give a certain amount of time to "cure" the repossession after that time is up, they are free to sell the collateral. Check with your state attorney general's office to find out what that time period is in your state. It is called a "Right to Cure".
A debtor who wishes to reopen a closed bankruptcy case to remove a lien normally has to first file a Motion to Reopen the bankruptcy case with the Bankruptcy Court. The Bankruptcy Court charges a $155.00 fee to do this (as of today's date, 2/25/05). If the debtor hired a lawyer to do this for him or her (highly advisable) then there will also normally be attorneys fees that the debtor has to pay as well. Once the case is reopened by the Court, the debtor (or more likely his or her attorney) then has to file a Motion to Avoid Judgment Lien pursuant to 11 U.S.C. 522(f)(1). It should be noted that NOT all judgment liens can be avoided by 522(f), only those that "impair an exemption of the debtor" pursuant to 11 U.S.C. 522(f)(2). One should speak to attorney about this. Can tax liens be dismissed under Chapter 7 or Chapter 13?
Even if you discharge a tax debt in a bankruptcy (which can be done in limited circumstances), the lien associated with that debt is not released by bankruptcy proceedings.
The result is that you may come out of bankruptcy with no tax liability, but there may still be a lien on your property. That lien attaches to any equity in your assets that existed prior to the bankruptcy and was exempted in the bankruptcy.
For example, if you owned your house and filed bankruptcy with $20,000 of equity in your home, you may have been able to exempt that equity in the bankruptcy through a homestead exemption (so that you could keep your home). If that happened, after your bankruptcy was discharged the IRS would still have a lien against you that attaches to that $20,000 of equity (but not to any equity that accrues after the bankruptcy filing).

Erin, congratulations on NOT wanting to get involved in a repo. Sell it to a lender?? PORBABLY NOT. Lenders want money NOT cars. But, you DO want to sell it if possible. Try to find a buyer at the highest possible price. Lets say your payoff is 10K and your best offer is 7 K. $3000 difference. BORROW the 3K,sell for 7K and pay off the loan. Great credit. Still have a loan for 3K that is much cheaper than 10K, NO collectors calling daily and great credit. You save yrs. of INTEREST on a judgement, hours of phone calls from collectors ect.
