Right now (Aug. 18, 2007) Arkansas law says that ANY person who is not pregnant may marry in Arkansas at ANY age with parental permission! The mistakenly-worded law reads as follows: "In order for a person who is younger than eighteen (18) years of age and who is not pregnant to obtain a marriage license, the person must provide the county clerk with evidence of parental consent to the marriage." (The word "not" before "pregnant" was not supposed to be there.) This new law took effect July 31, 2007. Since the Arkansas legislature is adjourned through year end, the Governor may need to call a special session to correct the law.

(This information was found in--not quoted from--an 8/18/07 AP article titled "Error in Ark. law allows children to wed".) Oct. 11, 2007 update: The law remains the same. Arkansas governor Mke Beebe declined to call a special session, saying the Arkansas Code Revision Commission could correct the error. But on October 10, an Arkansas circuit judge ruled that the commission did not have the power to make changes to the law's meaning; only the legislature did.

If and when the law is corrected, this answer must be updated. The lowest legal age anywhere in North America to get married without parental permission is 18. Most states will allow 16 or 17 with parental consent.

No, under Arkansas Law it can only be carried by a law enforcement officer, correctional officer, member of the armed forces or a licensed security officer while acting within the course and scope of their duties. In Arkansas we have a Concealed Handgun Carry License ( CHCL ) rather than a concealed carry permit, it is only valid for a firearm, nothing else, though currently it appears that if one has said permit one can not be charged with carrying a weapon while in their vehicle provided it is not a prohibited weapon.

Assuming one is not a felon one may however currently carry OC spray ( As long as it's under 150 cc, with or without CS ), A taser or stun gun ( The two are not the same by the way and one must be 18 or older to posses ) or a pocket stick ( kubaton, monadnock persuader ), though the latter may cause problems, particularly without keys attached, consult an attorney. As with any weapon they will all get one charged with aggravated assault at a minimum if one uses it on someone and it is later determined that it was not self-defense.

A.C.A. § 5-73-120. Carrying a weapon.

(a) A person commits the offense of carrying a weapon if he or she possesses a handgun, knife, or club on or about his or her person, in a vehicle occupied by him or her, or otherwise readily available for use with a purpose to employ the handgun, knife, or club as a weapon against a person.

(b) As used in this section:

(1) "Club" means any instrument that is specially designed, made, or adapted for the purpose of inflicting serious physical injury or death by striking, including a blackjack, billie, and sap;

(2) "Handgun" means any firearm with a barrel length of less than twelve inches (12'') that is designed, made, or adapted to be fired with one (1) hand; and

(3) (A) "Knife" means any bladed hand instrument that is capable of inflicting serious physical injury or death by cutting or stabbing.

(B) "Knife" includes a dirk, sword or spear in a cane, razor, ice pick, throwing star, switchblade, and butterfly knife.

(c) It is a defense to a prosecution under this section that at the time of the act of carrying a weapon:

(1) The person is in his or her own dwelling, place of business, or on property in which he or she has a possessory or proprietary interest;

(2) The person is a law enforcement officer, correctional officer, or member of the armed forces acting in the course and scope of his or her official duties;

(3) The person is assisting a law enforcement officer, correctional officer, or member of the armed forces acting in the course and scope of his or her official duties pursuant to the direction or request of the law enforcement officer, correctional officer, or member of the armed forces;

(4) The person is carrying a weapon when upon a journey, unless the journey is through a commercial airport when presenting at the security checkpoint in the airport or is in the person's checked baggage and is not a lawfully declared weapon;

(5) The person is a licensed security guard acting in the course and scope of his or her duties;

(6) The person is hunting game with a handgun that may be hunted with a handgun under rules and regulations of the Arkansas State Game and Fish Commission or is en route to or from a hunting area for the purpose of hunting game with a handgun;

(7) The person is a certified law enforcement officer; or

(8) The person is in a motor vehicle and the person has a license to carry a concealed weapon pursuant to § 5-73-301 et seq.

(d) (1) Any person who carries a weaponinto an establishment that sells alcoholic beverages is guilty of a misdemeanor and subject to a fine of not more than two thousand five hundred dollars ($2,500) or imprisonment for not more than one (1) year, or both.

(2) Otherwise, carrying a weapon is a Class A misdemeanor.

(c) A defendant convicted of a violation may be sentenced to pay a fine:

(1) Not exceeding one hundred dollars ($100) if the violation is defined by this code or defined by a statute enacted subsequent to January 1, 1976, that does not prescribe a different limitation on the amount of the fine; or

(2) In accordance with limitations of the statute defining the violation, if that statute prescribed limitations on the amount og the fine.

(d) Notwithstanding the limits imposed by this section, if the defendant has derived pecuniary gain from commission of an offense, then upon conviction thereof he may be sentenced to pay a fine not exceeding double the amount of such pecuniary gain. For purposes of this subsection, "pecuniary gain" means the amount of money or the value of property derived from the commission of the offense, less the amount of money or the value of property returned to the victim of the crime or seized by or surrendered to lawful authority prior to the time sentence is imposed.

(e) An organization convicted of an offense may be sentenced to pay a fine authorized by subsection (d) of this section or not exceeding double the maximum fine otherwise authorized upon conviction of the offense by subsections (a), (b), or (c) of this section.

= 5-4-401. Sentence = (a) A defendant convicted of a felony shall receive a determinate sentence according to the following limitations:

(1) For a Class Y felony, the sentence shall be not less than ten (10) years and not more than forty (40) years, or life;

(2) For a Class A felony, the sentence shall be not less than six (6) years nor more than thirty (30) years;

(3) For a Class B felony, the sentence shall be not less than five (5) years nor more than twenty (20) years;

(4) For a Class C felony, the sentence shall be not less than three (3) years nor more than ten (10) years;

(5) For a Class D felony, the sentence shall not exceed six (6) years;

(6) For an unclassified felony, the sentence shall be in accordance with the limitations of the statute defining the felony.

(b) A defendant convicted of a misdemeanor may be sentenced according to the following limitations:

(1) For a Class A misdemeanor, the sentence shall not exceed one (1) year;

(2) For a Class B misdemeanor, the sentence shall not exceed ninety (90) days;

(3) For a Class C misdemeanor, the sentence shall not exceed thirty (30) days;

(4) For an unclassified misdemeanor, the sentence shall be in accordance with the limitations of the statute defining the misdemeanor.

Unfortunately, this depends on gender. Hen mothers lose their parental rights, usually due to a conviction of child abuse, than no. But, when that happens to a father, than yes. Even in cases where the single mother loses her rights, the child is placed in foster care, and the father pays child support without having access rights, though he was not involved in the abuse. That's the case with a KCMO father right now who daughter called him when her mother killed his son last May. The girl is in foster care 250 miles from here and he's paying for it. For three years he's been trying to get custody due to her mental illness which has been documented by the police.
