Age child can be left alone overnight in NJ?

A child could usually stay home at the age of 7, but an ethical and responsible person wouldn't leave their child home alone before the age of 12.

Can a parent force an adolescent to go on birth control even if they are not sexually active?

No, in the US a minor has certain "fundamental liberties" one of which relates to the voluntary or involuntary use of contraception. That being the case, a physician cannot/will not, prescribe birth control for a minor if she is unwilling. That being the case, a court order is required before a parent can "force" a minor child to use birth control.

Is the custodial parent jeopardizing custody if he or she doesn't abide by the court ordered visitation schedule?

Yes. Child custody is decided on what's best for the child. So if its best for the child to go with him/her, then that is what the judge will decide. * It's possible, but the non custodial parent will still have to be notified of the proceedings and given the opportunity to object to the act. Considering the cited circumstances that hardly seems fair, but it is, in the US the law.

Why is it illegal for a minor to get a tattoo?

The law assumes a minor isn't mature enough to make an informed decision on altering their body permanently. Also, like any other service for pay, procuring a tattoo is a form of contract and a minor cannot enter a contract. The tattoo provider would have absolute liability.

At least 39 states have laws that prohibit tattoo for minors. Anyone who applies a tattoo on a minor may suffer serious legal consequences if there are any ill effects from the process. A prudent tattoo artist wouldn't take that risk. Even with parental permission a tattoo on a young child may be considered child abuse.

When can a truancy officer question a child at school with out parent consent?

Why are high school students dropping out?

there are many different reasons. One reason is because they didn't pass their s.a.t., and keep on taking it over again. Eventually they will get sick of taking the test. Another reason is because theyre doing bad in school, or they just being lazy and dont want to be in school. The most common reason is teen pregnancy.

Can a 17 year old sue for back child support?

Yes, as an adult you can sue a noncustodial parent for back child support. However it is a different story if the noncustodial parent has never been ordered to pay child support. You can still sue them for a percentage of their assets. I am currently working on a case in which my client is sueing his father for 15 years of back child support. Any divorce lawyer can handle this case for you.

Can a minor be emancipated from one parent or does it have to be from both?

The premise of emancipation is that the minor does not need adult intervention or assistance to conduct their affairs. Therefore it would not be possible to receive a decree of emancipation from only one parent. The minor must be able to provide proof of an acceptable level of income (their own, not money from a family member or friend); that will enable them to support themselves. They must have an established residence, present proof of being able to pay for utilities, food, clothing, medical care, education if applicable, transportation and so on and so on.

The mother of my children gets child support and my children don't live with her Is this illegal and can i take her to court for back pay?

You need to go to court to modify your child support agreement. Yes, as long as your old agreement hasn't been modified, she can legally collect child support from you. There may be provisions in your support agreement by which your children do not have to reside with her, especially if the money is still going toward their support. The court probably won't make your ex-wife pay back the money, but it will give you credit for having paid it.

What is the difference between joint custody and guardianship?

joint custody means both parents have custody of the children and all decisions concerning the children have to be a joint decision... including trips out of the state. I have not heard of access... I am thinkgin access is giving the non custodail parent visitation rights. Research the Laws for your state.

Are your parents legally allowed to throw away all your clothes because you refuse to fold them?

I personally don't think that parents should take there kids things. I don't think that it does anyone good. It could be worth a lot of money and people could take it and throw it away, and were did all your money just go? When you take things from your kids it is like steeling from someone else especially when it is something that you didn't buy, and what the kid saved up for. It is also not that fun for the kid to be sitting in the room with nothing to do, and the parents have to listen to them yell and scream that they are bored, so I don't think that you should take things from your kids.

If you are a minor, then yes, otherwise no. If you don't want your stuff thrown away so badly, then just dig it out of the trashcan and hide it in a better spot. Keep your stuff locked up if you don't want people to go through it, I hide all of my stuff so that my parents can't go through it without my knowning, plus I memorize every detail of my stuff's arrangement, which you should consider to keep them from being so sneaky.

Is it illegal to transport a minor across state lines without parent's permission?

Not technically, if they're under the age of 17 yes it is highly illegal ANYWHERE. So long as the person is 17 it is legal, Title 18, chapter 117, section 2423 and 2422 of the criminal code state; . So long as age of consent is proportional to the ones age your not taking part in a criminal offense so yes it is legal, its just nice to let the parents know.

What are the rights of a Missouri custodial parent needing to move out of state but less than 100 miles for career when the non custodial parent has extended non traditional visitation?

Custodial rights in any US state depends largely on the individual circumstances surrounding a dispute and the judge's interpretation of such. Generally the main contributing factors in the decision are. the ages of the children involved, the extent the non custodial parent and other relatives (grandparents, etc.) are currently involved with the children, the purpose of the relocation, and the plans for transportation of the children for visitation purposes. There are no certainties in such situtation. But a move when it pertains to the parent retaining their employment status does carry a considerable amount of weight in the matter.

Can you moveout at the age of 16 in Texas?

Not without legal emancipation or parental consent. The age of majority is 18. Apparently a few states, such as Texas and South Carolina, have a loophole in that 17-year-olds won't be forced back into their parents' house if they move out.

How long can a 17 year old stay home alone without the parent home in the state of FL?

The age at which a child can be left at home alone is only legislated in two states, Maryland and Illinois. The legal check is whether or not the child is safe and has the ability to take care of themselves. Most authorities agree that leaving a 12 year old alone at home for an hour or two is acceptable, but they should not be responsible for other children.

What happens with the child support order if the non-custodial parent is out of the state?

All US states honor and enforce child support orders issued by another state. The obligated parent is still bound by the terms of the support order regardless of his or her state of residency. The same actions can be taken to enforce the order in the state where the non custodial parent resides as would be possible in the state where the original order was issued.

Can a child sue a parent for the violation of one or more of their constitutional rights?

Laws vary depending on where you live. If your in the US you must have someone respresenting you, as a guardian or other family member and you must have proof that you are being abused and why you want to sue them and what for. If you live out of the country I dont know but I would venture to say that in certain countries, children dont have that option at all. You need to have a adult go with you to the court house and talk to the state attorneys office.

When is a child no longer considered a minor?

Federal law considers any person under the age of 18 to be a minor. That person is not able to enter into a contract and cannot be held accountable to any contract they might sign.

The issue can become somewhat more confusing if the minor is involved with a criminal act. While still a minor, the juvenile can be tried as an adult in some cases, if he is deemed to be competent enough to realize his actions were criminal in nature. Yet, even in the event that a minor is convicted of a felony and sentenced to prison incarceration, he is still considered a minor, and must be segregated from the adult population by the states' Departments of Corrections, and housed with others of his age until he is released or reaches the age of twenty-one.

Does the child have legal right to his father even if the parents never married but the father signed on his live birth as acknowledgement?

United States

Yes. That child has legal rights as his father's biological child. First, that child has the legal right to be financially supported by his father. Second, that child may have inheritance rights according to the law in the particular state or other jurisdiction. In the United States a minor child he cannot be disinherited if his father dies even if his father leaves all his property to someone else in his Will. His mother could file a claim against the estate. As an adult he can make a claim against the estate in some jurisdictions if his father dies intestate, or without a will.

If we legally change the child's surname does the father still have to pay child support?

No - the child's name is irrelevant to this.

But, he has the right to sue to change it back.

If the name was changed legally, then the biological father would have had to have given up his rights so that the child could be adopted by the stepparent. Depending on the state, county, etc,..... he may not have to pay.

If the father is paying child support to the mother and the child is living with the father. does he still pay child support?

This depends on a couple of things, the state you are in and what your court order says.

If the child is living full time with one parent it is the other parent who pays child support. However, if the child is living with the father for the summer (summer possession) the father will still continue to pay the mother child support even though the child temporarily is living with the father. The reason for this is the mother still has bills that are keeping the house and such for the child to come back too.

The only way a father will not have to pay is if the court order says that during summer possession the father does not have to pay child support, but normally in this case the mother would not be obligated to pay child support to the father.

However in the end, people should do what is best for the children and not worry about the dollars they receive or don't receive.

IS a 14 year. old allowed to have a relationship with a 17 year old?

Probably not. You should check your state's (or location's) local laws regarding statuatory rape. Generally, a 18 year old cannot have sex with a minor and a 16 year old cannot have sexual activities with a minor. In some states, it doesn't depend on an exact age but a certain age difference such as a minor cannot be in a relationship with someone 3 years her senior. Statuatory rape is punishable.
