Can you work if you apply for disability?
Whether or not you are able to work while collecting Disability insurance benefits will be entirely dependent on the definition of total disability (description of the circumstances in which you are eligible for a claim), in your insurance contract. These are the most common variations available on today's market.
True Own-Occupation Definition of Total DisabilityYou will be considered totally disabled if, due to injury or sickness, you are unable to perform the material and substantial duties of your occupation, even if you are gainfully employed in another occupation.
Modified Own-Occupation Definition of Total Disability
You will be considered totally disabled if, due to injury or sickness, you are unable to perform the material and substantial duties of your regular occupation and are not gainfully employed elsewhere.
Any-Occupation Definition of Total DisabilityYou will be considered totally disabled if, due to injury or sickness, you are unable to perform any occupation for which you are reasonably fitted by your education and experience; and are not gainfully employed.
*Every insurance company will have a separate version of these definitions. These descriptions should be used to help understand the differences, but not as any form of guarantee.
The easiest way to separate the different definitions is by knowing whether you have your own individual coverage, group coverage offered at work or are simply relying on Social Security benefits.
Traditionally, True-Own occupation Disability insurance will only be available in a personally owned policy. Occasionally companies will use a True or Modified Own occupation definition for the first 24-60 months of a contract, but then change to an Any-occupation definition. Again, you need to check the guidelines of your policy in order to know what your policy offers you.
Group coverage will often have a True or Modified Own-Occupation definition of disability for the first 24-36 months of a claim and then turn to an Any-Occupation definition. Talk with your Human Resource department or office manager to learn more about what your group coverage offers. If that person does not know, you should either have them call the company that provides your coverage, or call yourself and ask for policy information.
Social Security disability insurance uses an Any-Occupation definition of disability, at best. In order to qualify for Social Security benefits, you must be unable to perform any occupation and there also must be a strong indication that your claim will continue for multiple year at the least.
To summarize, you may be able to obtain benefits while working if you have an individual or group policy that provides a True Own-Occupation definition of Total disability. With Social Security benefits you are not able to do so.

In order to qulify for disability a doctor must fill out forms diagnosing an actual condition that creates this diability. In some states there is such a thing a temporary disability, like Califonrnia. This is through the Employment Development Department. Some states, such as Nevada, do not. Either way there must be a diagnosis from a doctor who states that indeed the patient is either physically, mentally, or psychologically incapable of working for a determined amount of time. Under a year qualifies for temporary in states that have that, or more than a year for permanent diability. If someone is disabled for three years, for example, they can still reverse their status as a disabled person at any time. You can also work up to a certain amount of hours per week while on permanent disabilty. Permanent disability is handled by the Social Security department. Most people are denied permanent disability by the SSD and must appeal. This is where the fight really begins and most people will retain the services of a disability lawyer who will then claim 25% of the person's money owed to them. There is a formula the deptartment uses to figure this amount. Most people with legitimate disablities will be approved the second time of application. Disabiltiy will back pay. Go to www.ssa.gov
If you are receiving benefits from Social Security Disability Insurance (SSDI), child support can be taken from your SSDI payments. However, if you are receving Supplemental Security Income, that cannot be seized for child support.
Can I be terminated when short-term disability expires?
Actually you can be terminated BEFORE your disability expires. Family leave laws work independently of disability insurance coverage.
FMLA and several state laws provide for unpaid job protected leave. FMLA provides 12 weeks of leave. The law applies to employers with more than 50 employees. Other qualifying criteria apply.
Short term disability replaces a portion of your income during the time you are unable to work. Benefits can last from 3 months to 24 months. Your employer is not bound by the length of the short term disability benefit period.
Sure, but it's a waste of time. Applying for disability is a pain in the a** and it won't get you any more money. You should be collecting regular Social Security right now, even if you're still working.
Does Alabama have short term disability?

What age can ex wife receive benefits if the ex husband retires at age 50 on disability?
As soon as the husband begins collecting it, but the ex wife can only collect it if there is a standing court order pertaining to to.
You should attempt to redefine your question. If a government is seeking to constrain the rights of the disabled, it will always start by defining what "disabled" means: you must be labeled, packaged and filed under the correct key cards. That way the the government can gatekeep.
However, it is self evident that being disabled is not a collection of labels or medically definable conditions. A view of the whole person must ask: how should society be expected to treat this person, when all about them is understood?
I accordingly don't even think the law should be fcuking with questions of who is disabled and who is not. We are every one of us, disabled at times after all. This is not a concept that can or should be defined.

Are you talking about Social Security Disability? It would depend on if you were married 10 years or longer and how much your receiving compared to what you might get on your husband's benefit. Check Social Securitys website. It's VERY extensive. If you can't find the answer, Social Security has a email inquiry section that responds PROMPTLY.
I have been approved for disability social security benefits how do i find out what they are?
The social security administration will be the only one that should be able to tell you the amount of the social security disability income amount that you will receive each month. You should be receiving a notice or letter from them with this information.
You can try calling 1-800-772-1213, you can use the SSA automated telephone services to get recorded information and conduct some business 24 hours a day.
If you cannot handle your business through the SSA automated services, you can speak to a Social Security representative between 7 AM. and 7 PM. Monday through Friday.
THE QUESTION ISN'T VERY CLEAR, AND INCLUDES CONTRADICTIONS. If you work 40 hours for an employer, it must pay you for those hours. If you have a 50% disability, you might or might not have restrictions on working: millions of profoundly disabled folks work full-time. Since "50% disabled" folk can work as much as they can tolerate, nothing says such a person could not work overtime for Employer A, or work 40 hours for Employer A, plus part-time or full-time for Employer B. So no program will pay "extra money" to a disabled person based on your scenario. Of course, VA disability continues to pay a disabled vet who works, and workers comp pays for a perm partial disability even if one works. But that has nothing to do with NOT working a second job.

If she no longer a dependent of yours she should no longer be entitled to the payments. They should have been paid to you anyway for her behalf if I'm not mistaken. I'm sure a check was never sent in the name of a minor. Make sure she does not call them pretending to be you and change the direct deposit account. Call SS to make sure no change has been made without your permission and maybe tell them not to let it be changed.
