A keg is technically any type of steel container used to serve beer from using either pressurized air for carbon dioxide. What most people think of a keg is actually a 1/2 barrel. A barrel is equal to 31 gallons (US). What most people call a keg is actually a 1/2 barrel, so 15.5 gallons.

Not only is it illegal you are opening yourself to all sorts of other potential problems. There was recently a case in the news where an illegal who was working on someones house fell off the roof and got seriously injured. The illegal sued the homeowner for a couple of hundred thousand and won. The homeowners policy would not pay because the home owner committed a crime by hiring an illegal so the guy was on the hook for the whole judgment.

I personally know some one who hired a couple of Mexicans to cut down a tree in his yard because they would do it cheap. Needless to say the tree fell on his neighbors house and they all ran away. So keeping the flow of gas from the fermentation vessel "one-way" is very important. That said, you don't have to be fancy. Plastic airlocks and sized stoppers are only a couple of dollars at most. Whiskey is distilled form wort (basically a beer without hops). Any sugars in the wort remain in the still. The only sugars in whiskey come from the barrels that the whiskey is aged in, and those are present in very, very small quantities.
